Under and by virtue of the power of

sale contained in the Security Deed

dated November 16, 1998, from

Brent J. Kates and Victoria C. Kates

to Nationscredit Manufactured

Housing Corp., filed for record on

November 18, 1998, and recorded

in Deed Book 435, Page 272, in the

office of the Clerk of the Superior

Court of Worth County, Georgia,

and last assigned to Green Tree

Servicing, LLC, the undersigned will

sell at public outcry during the legal

hours of sale before the door of the

courthouse in Worth County, Geor-

gia, on the first Tuesday in March,

2013, to the highest bidder for cash,

the following described real proper-

ty: All that tract or parcel of land sit-

uate, lying and being in Land Lot

No. 319 in the 7th Land District of

Worth County, Georgia, being 1.00

acres, more or less, designated as

Lot 45, and more particularly de-

scribed on that plat of survey enti-

tled roperty of Victoria C. Kates

and Brent J. Kates, prepared by H.J.

Griffin & Associates, Georgia Reg-

istered Surveyors, dated 11/2/98,

and recorded in Plat Book 28, Page

343 of the deed records of Worth

County, Georgia, and which plat of

survey is incorporated herein and

made a part hereof for a more defi-

nite description. Also located on the

property is a mobile home described

as follows: 1999 Sweetwater Mobile

Home, Manufacturer ID No.

SHGA4642AB. The debt secured by

said Security Deed is evidenced by

a Note dated November 16, 1998, in

the principal amount of Eighty Thou-

sand Nine Hundred Sixty-Eight and

05/100 Dollars ($80,968.05) exe-

cuted by Brent J. Kates and Victoria

C. Kates in favor of Nationscredit

Manufactured Housing Corp. The

debt secured by said Security Deed

and evidenced by said Note has

been and is hereby declared due

and payable because of grantor

failure to comply with certain terms

and conditions in said Security

Deed. The debt remaining in default,

this sale will be made for the pur-

pose of paying said indebtedness

including all accrued and unpaid

interest thereon and attorney fees

and all expenses of said sale. Said

property will be sold subject to any

outstanding ad valorem taxes

(including taxes which are a lien, but

not yet due and payable), the right

of redemption of any taxing author-

ity, any matters which might be dis-

closed by an accurate survey and

inspection of the property, any as-

sessments, easements, liens, en-

cumbrances, zoning ordinances, re-

strictions, covenants, and matters of

record superior to the Security Deed

first set out above. To the best of the

undersigned knowledge and be-

lief, said property is also known as

129 Middle Trail Road, Sylvester,

Georgia 31791, and the parties in

possession of the property are Brent

J. Kates and Victoria C. Kates or

tenants of Brent J. Kates and Vic-

toria C. Kates. Notice has been giv-

en of intention to enforce provisions

for collection of attorney fees and

foreclosure in accordance with legal

requirements and the terms of said

Security Deed and Mortgage Note.

The sale will be conducted subject

(1) to confirmation that the sale is

not prohibited under the U.S. Bank-

ruptcy Code and (2) to final confir-

mation and audit of the status of the

loan with the holder of the security

deed.
