WORTH COUNTY

Pursuant to the Power of Sale con-

tained in a Security Deed given by

Kelly C. Price and Perry D. Price to

Mortgage Electronic Registration

Systems, Inc. as nominee for ERA

Mortgage dated 9/19/2008 and re-

corded in Deed Book 808 Page 343,

WORTH County, Georgia records;

as last transferred to PHH Mortgage

Corporation, conveying the after-de-

scribed property to secure a Note in

the original principal amount of $

144,000.00, with interest at the rate

specified therein, there will be sold

by the undersigned at public outcry

to the highest bidder for cash before

the Courthouse door of WORTH

County, Georgia, within the legal

hours of sale on March 5, 2013

(being the first Tuesday of said

month unless said date falls on a

Federal Holiday), the following de-

scribed property: All that tract or par-

cel of land lying and being in Land

Lot 67 in the 15th Land District,

Worth County, Georgia, and being

all of Tract 3, according to a plat of

the property entitled urvey for Lar-

ry W. and Penny L. Templeton and

Belinda Burton, Russell Martin and

others prepared by Medders As-

sociates Surveying, Inc, Georgia

Registered Land Surveyor No.

2353, as same is recorded in Plat

Book 30, Page 88, in the Office of

the Clerk of Superior Court of Worth

County, Georgia. The described

tract contains 15.89 acres, more or

less. Said property is known as 265

Camp Osborne Road, Sylvester, GA

31791. The debt secured by said

Security Deed has been and is

hereby declared due because of,

among other possible events of de-

fault, failure to pay the indebtedness

as and when due and in the manner

provided in the Note and Security

Deed. The debt remaining in default,

this sale will be made for the pur-

pose of paying the same and all ex-

penses of this sale, as provided in

the Security Deed and by law, in-

cluding attorney fees (notice of in-

tent to collect attorney fees having

been given). FEDERAL NATIONAL

MORTGAGE ASSOCIATION is the

current owner of the loan. Said

property is commonly known as 265

Camp Osborn Road, Sylvester,

Georgia 31791 together with all fix-

tures and personal property at-

tached to and constituting a part of

said property, if any. To the best

knowledge and belief of the under-

signed, the party (or parties) in pos-

session of the subject property is

or individual designated, who shall

have full authority to negotiate,

amend and modify all terms of the

mortgage pursuant to established

right of redemption of any taxing au-

thority, (c) any matters which might

be disclosed by an accurate survey

and inspection of the property, and

(d) any assessments, liens, encum-

brances, zoning ordinances, re-

strictions, covenants, and matters of

record superior to the Security Deed

first set out above. Said property will

be sold subject to: (a) any out-

standing ad valorem taxes

(including taxes which are a lien, but

not yet due and payable), (b) unpaid

water or sewage bills that constitute

a lien against the property whether

due and payable or not yet due and

payable and which may not be of

record, (c) the right of redemption of

any taxing authority, (d) any matters

which might be disclosed by an ac-

curate survey and inspection of the

property, and (e) any assessments,

liens, encumbrances, zoning ordi-

nances, restrictions, covenants, and

matters of record superior to the Se-

curity Deed first set out above. The

sale will be conducted subject to (1)

confirmation that the sale is not pro-

hibited under the U.S. Bankruptcy

Code; and (2) final confirmation and

audit of the status of the loan with

the holder of the Security Deed. Pur-

suant to O.C.G.A. Section 9-13-

172.1, which allows for certain pro-

cedures regarding the rescission of

judicial and non-judicial sales in the

State of Georgia, the Deed Under

Power and other foreclosure docu-

ments may not be provided until fi-

nal confirmation and audit of the

status of the loan as provided im-

mediately above.
