NOTICE OF SALE

GEORGIA, LANIER COUNTY.

By virtue of a power of sale contained in that certain Deed to Secure Debt from BLACKACRE PROPERTIES, LLC to COLONY BANK VALDOSTA, FSB AN OFFICE OF COLONY BANK QUITMAN, FSB ORGANIZED AND EXISTING UNDER THE LAWS OF THE UNITED STATES OF AMERICA, dated February 1, 2008, and recorded in Deed Book 189, Page 371, et seq., in the Office of the Clerk of Superior Court of Lanier County, Georgia, said Deed to Secure Debt having originally been given to secure that certain Promissory Note in the original principal amount of ONE HUNDRED THOUSAND AND NO/100 DOLLARS ($100,000.00) of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description, then or thereafter owing by BLACKACRE PROPERTIES, LLC to COLONY BANK VALDOSTA, FSB AN OFFICE OF COLONY BANK QUITMAN, FSB ORGANIZED AND EXISTING UNDER THE LAWS OF THE UNITED STATES OF AMERICA, which Promissory Note has been reduced to judgment against BLACKACRE PROPERTIES, LLC in Civil Action Number 12-CV-388 in the Superior Court of Lowndes County, Georgia (the Judgment ), there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Lakeland, Lanier County, Georgia, within the legal hours of sale on the first Tuesday in December, 2012, the following described property:

All that tract or parcel of land situate, lying and being in Land Lot No. 450 and 471 in the 10th Land District of Lanier County, Georgia, and being more particularly described as Lot 111 of Mill Pond Plantation Subdivision Phase One, according to a map or plat of survey thereof recorded in Plat Cabinet A, Page 143P-Q, in the Office of the Clerk of the Superior Court of Lanier County, Georgia, to which map or plat of survey and the record whereof reference is hereby made for all purposes in aid of description.

THE STREET ADDRESS OF THE ABOVE-DESCRIBED PROPERTY IS 19 MILL POND PLACE, LAKELAND, LANIER COUNTY, GEORGIA 31635, TO THE BEST OF THE KNOWLEDGE AND BELIEF OF COLONY BANK VALDOSTA, FSB AN OFFICE OF COLONY BANK QUITMAN, FSB ORGANIZED AND EXISTING UNDER THE LAWS OF THE UNITED STATES OF AMERICA.

The indebtedness secured by the aforementioned Deed to Secure Debt has been declared immediately due and payable in full because of the failure of BLACKACRE PROPERTIES, LCC to pay the Judgment owing to COLONY BANK VALDOSTA, FSB AN OFFICE OF COLONY BANK QUITMAN, FSB ORGANIZED AND EXISTING UNDER THE LAWS OF THE UNITED STATES OF AMERICA in accordance with its terms. Said Judgment remaining outstanding and unpaid, this sale shall be made for the purpose of paying such Judgment, as well as all expenses of this sale, including attorneys fees.

The above-described properties will be sold as properties of BLACKACRE PROPERTIES, LLC and will be sold subject to the following items which may affect the title to said properties: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the properties; all real property ad valorem taxes or assessments, which may constitute liens upon said properties; all liens which, under applicable law, would take priority over the Deed to Secure Debt described above; and all easements, restrictions, rights-of-way, security deeds or other encumbrances of record which have priority over the referenced Deed to Secure Debt.

To the best of the knowledge and belief of the undersigned, the party presently in possession of said property is BLACKACRE PROPERTIES, LLC and/or a tenant or tenants.

THIS LAW FIRM IS ATTEMPTING TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
