NOTICE OF SALE GEORGIA, MITCHELL COUNTY. WHEREAS, on May 16, 2008, Jakie J. Williams, did execute and deliver to Bank of Camilla a certain Deed to Secure Debt, conveying the following described property, to-wit: See Exhibit attached hereto and made a part hereof by reference; and WHEREAS, said Deed to Secure Debt is of record in Deed Book 889, pages 227, et. seq., in the office of the Clerk of Superior Court of Mitchell County, Georgia; and WHEREAS, said Deed to Secure Debt secured the payment of a certain Pr omissory Note, dated May 16, 2008, in the original principal amount of Sixty One Thousand Six Hundred Thirty-Eight and 50/100 Dollars ($61,638.50), plus interest as set out therein, plus all other indebtedness(es) then or thereafter owing by Jackie J. Williams to Bank of Camilla as set out therein; and WHEREAS, the indebtedness represented by said Promissory Note dated May 16, 2008, and all other indebtedness(es) owing by Jakie J. Williams to Bank of Camilla, and secured by said Deed to Secure Debt, have become in default, and the entire unpaid principal amount(s), together with accrued interest thereon, is/are now past due; and WHEREAS, said Deed to Secure Debt contains a Power of Sale authorizing the Grantee therein, as Attorney-in-Fact for the Grantor therein, to sell the property conveyed thereby in order to satisfy the said indebtedness(es) which is/are now past due, after advertising the same once a week for four (4) weeks in the official gazette of said county; and WHEREAS , the notices required by O.C.G.A. 44-14-162.1, et seq., have been or will be duly and properly given by the Holder of the said Deed to Secure Debt; NOW, THEREFORE, in accordance with said Power of Sale, and by virtue thereof, the Holder will sell the property described on Exhibit at public outcry to the highest and best bidder for cash on the first Tuesday in March, 2013, at the place of public sales before the Courthouse door in Mitchell County, Georgia, within the legal hours of sale. The said property will be sold subject to unpaid ad valorem taxes and unpaid street assessments and lien(s) for unpaid ad valorem taxes and unpaid street assessments, if any, unpaid taxes due to the State of Georgia and liens for unpaid taxes due to the State of Georgia, if any, unpaid taxes due to the United States of America and liens for unpaid taxes due the Untied States of America, if any, and any rights of redemption in favor of the United States of America and/or any agency thereof, including, but not limited to, the Internal Revenue Service. The said property will also be sold subject to those exceptions as shown on Exhibit attached hereto and made a part hereof by reference. The said property will be sold as the property of Jakie J. Williams, who, to the best of the undersigned knowledge and belief, is the party in possession of said property. The proceeds of the sale will be used as follows: (a) To pay the expenses of said sale; (b) To pay the sums secured by said Deed to Secure Debt; and (c) The balance, if any, to the person or persons legally entitled thereto.
