NOTICE OF SALE
GEORGIA, THOMAS COUNTY.
WHEREAS, heretofore on October 23, 2006, Dolly Graham did execute to Commercial Bank, now Synovus Bank, f/k/a Columbus Bank and Trust Company, as successor in interest through name change and merger with Commercial Bank, d/b/a Commercial Bank, division of Synovus Bank, a certain security deed to the following land:
Tract I: All that tract or parcel of land situate, lying and being in Land Lot 37 of the 13th Land District of Thomas County, Georgia, containing 4.05 acres, more or less, and being more particularly described according to an individual plat of survey thereof prepared by W. E. Rountree, Licensed Surveyor #622, dated October 24, 1956 and of record in Plat Book 3, Page 613 of the deed records of Thomas County, Georgia, which said plat of survey by reference thereto is incorporated herein and made a part hereof for a more definite description of the property herein conveyed.
EXCEPT for that portion of the within described property lying within the boundaries of Tract II described below.
Tract II: All that tract or parcel of land being 0.5002 acres located in Land Lot 37 of the 13th Land District of Thomas County, Georgia, being more particularly shown and delineated as Tract 1 on plat of survey prepared for Dolly Graham dated June 19, 1996 drawn by Sowega Surveying Services, GRLS #2527, and recorded in Plat Cabinet 3, Slide 8-A, Land Records of Thomas County, Georgia.
Tract III: That certain tract of land being in Land Lot 37 in the 13th Land District of Thomas County, Georgia, beginning at a stake on the north line of what was formerly known as Dixon Carroll land and running thence east along said line 40 rods to the Atlantic Coastline Railroad right-of-way; thence northward along said right-of-way to a branch; thence westward up said branch 40 rods to a gum tree in said branch; thence southward along the line of what is known as R. T. Hadleys line 50 rods to starting point; containing 17 acres, more or less, and known as Jasper Randall land, the said tract fronting on the Boulevard and being the property conveyed by deed from James Evans to Mrs. Greene Alday on October 1, 1935 as shown by deed recorded in Book 5-G, Folio 521, deed records of Thomas County, Georgia.
This being the same property as described in a Warranty Deed from Lizzie King to Fred King and Clayton King dated March 7, 1964 and recorded among the deed records of Thomas County, Georgia.
LESS AND EXCEPTED FROM THE ABOVE-DESCRIBED TRACTS I, II AND III AND NOT INCLUDED IN THIS FORECLOSURE IS THE FOLLOWING PROPERTY:
All that tract or parcel of land situate, lying and being in Land Lot Number 37 of the 13th Land District of Thomas County, Georgia, containing 3 acres, more or less, and being a portion of the property described on a plat of survey prepared for Fred King by W.E. Rountree, dated October 24, 1956, a copy of which plat is recorded in Plat Book 3, folio 613 of the Public Records of Thomas County, Georgia, and being more particularly described as follows: BEGINNING at the point where the north margin of Pinetree Boulevard intersects the west margin of the Seaboard Coastline Railroad right-of-way (formerly Atlantic Coastline Railroad Right-of way) and from said point run thence north 6 degrees 30 minutes east along the west margin of said railroad right-of-way a distance of 208 feet to the run of a branch; run thence in a northwesterly direction along the run of said branch to an iron pin located north 89 degrees west a distance of 274 feet from the previous point; continue thence in a northwesterly direction along the run of said branch to an iron pin that is located north 82 degrees west a distance of 127 feet from the previous post; continue thence in a northwesterly direction along the run of said branch to an iron pin that is located north 84 degrees 30 minutes west a distance of 194 feet from the previous point; continue thence in a northwesterly direction along the run of said branch to an iron pin that is located north 79 degrees west a distance of 188 feet from the previous point; thence south 1 degree west a distance of 185 feet, more or less, to a point located on the northerly margin of North Pinetree Boulevard; thence north 74 degrees east along the northerly margin of North Pinetree Boulevard a distance of 110 feet, more or less, to an iron pin; thence north 82 degrees east along the northerly margin of North Pinetree Boulevard a distance of 168 feet to an iron pin; thence south 68 degrees east along the northerly margin of North Pinetree Boulevard a distance of 470 feet to a point where the northerly margin of North Pinetree Boulevard intersects the west margin of the Seaboard Coastline Railroad right-of-way (formerly Atlantic Coastline Railroad right-of-way) and the point of beginning of the property herein conveyed.
Tracts I and II (excluding the excepted property) is known as 2304 North Pinetree Boulevard, Thomasville, Georgia, and is Tax Parcel 55-57A.
Tract III is known as 2303 North Pinetree Boulevard, Thomasville, Georgia, and is Tax Parcel 3-10-9.
WHEREAS, said security deed secures a note from Dolly Graham to Commercial Bank dated May 8, 2009 in the original amount of Ninety-Eight Thousand Seven Hundred Ninety-Seven and 41/100 Dollars ($98,797.41) and all other indebtedness then owing or thereafter arising between the parties, all shown by a security deed recorded in the office of the Clerk of the Superior Court of Thomas County, Georgia, in Deed Book 1345, Page 395; and
WHEREAS, said note has matured and is due and payable, and the undersigned has elected that the entire debt, principal and interest, become due at once as provided in said note and security deed and to proceed with foreclosure as provided for in the security deed..
NOW, THEREFORE, according to the original terms of said security deed and pursuant to the power of sale contained therein and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the above described property, after proper advertisement, on the first Tuesday in August, 2012 during the legal hours of sale at the Thomas County Judicial Center in Thomasville, Thomas County, Georgia.
Said property will be sold subject to taxes for the year 2012 and any prior unpaid taxes, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the security deed first set out above.
The proceeds from said sale will be used, first to the payment of said note, principal, interest and expenses and attorney's fees for which proper notice is given, and the balance, if any, delivered as provided in said security deed.
