NOTICE OF SALE

GEORGIA, WORTH COUNTY.

By virtue of a power of sale con-

tained in that certain Deed to Se-

cure Debt from LUTHER OVER-

STREET AND KAREN OVER-

STREET to AMERIS BANK, Suc-

cessor-in-Interest to TIFTON BANK-

ING COMPANY, dated August 14,

2008, and recorded in Deed Book

808, Page 262 et seq., in the Office

of the Clerk of Superior Court of

Worth County, Georgia, said Deed

to Secure Debt having originally

been given to secure that certain

Promissory Note in the original prin-

cipal amount of TWO HUNDRED

SEVENTY SEVEN THOUSAND

ONE HUNDRED FIVE and 00/100

DOLLARS ($277,105.00) of even

date therewith, as well as all exten-

sions, renewals and modifications

thereof, together with any and all

other indebtedness, of any type or

description, then or thereafter owing

by LUTHER OVERSTREET AND

KAREN OVERSTREET to AMERIS

BANK, Successor-in-Interest to TIF-

TON BANKING COMPANY, there

will be sold by the undersigned, at

public outcry, to the highest bidder

for cash, before the courthouse

door at Sylvester, Worth County,

Georgia, within the legal hours of

sale on the first Tuesday in Sep-

tember, 2012, the following de-

scribed property: All of Lot 12 of Ca-

sino Annex Subdivision as the same

is shown on the plat of said subdivi-

sion prepared by Carl J. Story, Sur-

veyor, dated July, 1944, recorded in

Plat Book 1, Pages 90-91 in the Of-

fice of the Clerk of the Superior

Court of Worth County, Georgia.

Less & Except that certain part or

portion of Lot 12 more particularly

described as follows: Begin at the

southwest corner of said Lot 12 and

go thence north 26 10 west a dis-

tance of 185.1 feet to the north mar-

gin of said Lot 12 (Lake Blackshear

Swift Creek); go thence south 71 42

west a distance of 6.0 feet to the

northwest corner of said Lot 12; go

thence south 28 00 east along the

west margin of said Lot 12 a dis-

tance of 186.0 feet to the southwest

corner or said Lot 12 and the point

of beginning. The above described

property is conveyed subject to the

restrictions contained in that certain

warranty deed from L.C. Whitfield to

Harlan E. Sutton dated July 9, 1951,

and recorded August 29, 1951, in

Deed Book 91, Page 72, Public

Records, Worth County, Georgia.

Also conveyed is a one-third interest

in the well located on the subject

property. The indebtedness secured

by the aforementioned Deed to Se-

cure Debt has been and is hereby

declared immediately due and pay-

able in full because of the failure of

LUTHER OVERSTREET AND KAR-

EN OVERSTREET to maintain pay-

ments upon said indebtedness ow-

ing to AMERIS BANK, Successor-in-

Interest to TIFTON BANKING COM-

PANY in accordance with its terms.

Said indebtedness remaining in de-

fault, this sale shall be made for the

purpose of paying such indebted-

ness, as well as all expenses of this

sale, including attorneys fees. The

above-described property will be

sold as the property of LUTHER

OVERSTREET AND KAREN OVER-

STREET and will be sold subject to

the following items which may affect

the title to said property: all zoning

and subdivision ordinances and/or

regulations; matters which would be

disclosed by an accurate survey or

an inspection of the property; all real

property ad valorem taxes or as-

sessments, which may constitute li-

ens upon said property; all liens

which, under applicable law, would

take priority over the Deed to Se-

cure Debt described above; and all

easements, restrictions, rights-of-

way, security deeds or other en-

cumbrances of record which have

priority over the referenced Deed to

Secure Debt. To the best of the

knowledge and belief of the under-

signed, the parties presently in pos-

session of said property are LU-

THER OVERSTREET AND KAREN

OVERSTREET and/or a tenant or

tenants.
