NOTICE OF SALE OF PUBLIC PROPERTY BY SEALED BID The Board of Commissioners of Coweta County, Georgia has declared surplus the following property: Tract 1 All that tract or parcel of land designated as Tax Parcel 046-5127-054 situate lying and being in land lots 98 and 127 of Coweta County, Georgia, and being described with reference to a plat dated October 1982 entitled Pump House Lot, Sargent, Georgia (which plat is recorded in the Office of the Clerk of the Superior Court of Coweta County, Georgia in plat book 31, page 23) as follows: From the intersection of the extension of the centerline of Arnco Street and the east edge of pavement of Ga. Highway 16 (Newnan Street) along the east edge of pavement of Highway 16 in a southeasterly direction 61.8 feet to a point. Thence 55.5 feet N51 -47 E to a point on the east right of way line of Ga. Highway 16. This point is on the property line for lots 155 and 156 of the Arnall and Arnco Village Subdivision Plat by Piedmont Engineers and Architects, Greenville, SC dated October 1970. Tract 2 All that tract or parcel of land designated as Tax Parcel 046-5127-053 located in Land Lot 127, 5th Land District, Coweta County, Georgia conveyed to Coweta County, Georgia, by Tax Deed recorded in Deed Book 2951, Page 259, by virtue of a writ(s) of fiery facias against JDL Ventures, Inc., the Taxpayer(s), and more particularly described as being .73 acres, more or less, being the Common Area, Hamilton Plantation Subdivision, as shown in Plat Book 57, page 112, being located on Hamilton Drive. Tract 2, described-above, was deeded to Coweta County, Georgia by virtue of a tax deed. THIS SALE IS SUBJECT TO THE TAX-PAYER S RIGHT OF REDEMPTION. COWETA COUNTY, GEORGIA DOES NOT WARRANT TITLE AND DOES NOT TRANSFER MARKETABLE TITLE TO THIS PROPERTY BY VIRTUE OF ITS QUIT-CLAIM DEED. The minimum bid amount Coweta County will accept is $2,513.00. The property shall be awarded to the highest bidder on Monday October 29th, 2012, at 3:00 p.m. All those interested in the above-described property may submit sealed bids by no later than 3:00 p.m., Monday October 29th, 3:00 p.m., 2012 to the Coweta County Clerk located in 22 East Broad Street, Newnan, Georgia, Room No. 206. Bids shall be opened in public at the Commission Meeting Room located above the Coweta County Tax Assessors Office, 22 East Broad Street on Monday, October 29th, 2012 at 3:00 p.m. The successful bidder must have the bid amount in cash or certified funds at the time of the bid opening to be awarded the property. If highest bidder has not provided the bid amount in cash or certified funds at the time of the bid opening, the property shall be awarded to the next highest bidder. The property shall be sold as a single block and shall not be sold as separate tracts. The property shall be transferred by Quit-Claim Deed to the successful bidder by the Board of Commissioners at its next regular meeting directly following the acceptance of the bid amount. Coweta County, Georgia has the right to reject any and all bids. Coweta County, Georgia does not warrant title to the property and shall convey the subject property to the successful bidder by Quit-Claim Deed. For Tract 2, the Quit-Claim deed will include an acknowledgement by the successful bidder that the bidder is aware that the Tax Payer s Right of Redemption still exists and that the successful bidder has received only that interest in the property Coweta County obtained by virtue of its tax sale deed. Coweta County is not conveying and cannot convey marketable title in this property by virtue of its tax deed. Coweta County has not performed a title search on either property. Tract 2 is being sold subject to the Tax Payer s Right of Redemption. Coweta County has not taken action to cut off the right of redemption pursuant to O.C.G.A. Section 48-4-45 et seq.
