NOTICE OF SALE
STATE OF GEORGIA
COUNTY OF LANIER
Under and by virtue of the power of sale in that certain Deed to Secure Debt from RAYOND SCOTT LOWERY, a/k/a RAYMOND SCOTT LOWERY, of the County of Lanier, State of Georgia as Grantor, to FARMERS AND MERCHANTS BANK, of the County of Lanier, State of Georgia, as Grantee, dated September 8, 2008, as recorded in Deed Book 198, Pages 110-111, in the Office of the Clerk of the Superior Court of Lanier County, Georgia. Said Deed to Secure Debt is in the original principal amount of $123,572.62, together will all other indebtedness owing by the said Grantor to the said Grantee, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Lanier County Courthouse, located at 56 West Main Street, Lakeland, Lanier County, Georgia, on the first Tuesday in December, to wit; December 4, 2012, to wit:
All that tract or parcel of land situate, lying and being 0.490 acres in Land Lot No. 491 of the 10th Land District of Lanier County, Georgia, more particularly identified as Tract 1 on that plat of survey prepared by Albert E. Slone, Georgia Registered Surveyor No. 2406, dated May 14, 1998 and recorded in Plat Cabinet A, Slide 84 in the Office of the Clerk of the Superior Court, Lanier County, Georgia. Said plat and the recorded copy thereof are, by reference, incorporated herein and made a part of this description.
There is located thereon a structure known and designated as 933 Thigpen Avenue by the present system of numbering in Lakeland, Lanier County, Georgia.
Subject to: A perpetual easement for the purpose of ingress and egress conveyed to John Browning on August 27, 1998, as recorded in Deed Book 85, Page 103, in the Office of the Clerk of Superior Court, Lanier County, Georgia. Said easement located upon the following lands, to wit: All that tract or parcel of land situate, lying and being in Land Lot 491 of the 10th Land District, of the City of Lakeland, Lanier County, and being described as follows: For a POINT OF BEGINNING, begin at an iron pin at the Northeast corner of Tract 1 described above. From said POINT OF BEGINNING run thence South 02 degrees 02 minutes 40 seconds East a distance of 30 feet to a point; run thence in a westerly direction along an agreed line a distance of 95 feet, more or less, to a point on the West property line of Tract 1; run thence North 05 degrees 05 minutes 52 seconds East a distance of 30 feet to an iron pin; run thence South 86 degrees 14 minutes 03 seconds East a distance of 88.91 feet to an iron pin and the POINT OF BEGINNING.
The debt secured by said Deed to Secure Debt has been, and is hereby declared, due and payable in full because of default pursuant to the terms of said Deed to Secure Debt. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with legal requirements in the terms of the Deed to Secure Debt. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt, including attorney's fees, and the remainder, if any, shall be applied as provided by law.
To the best of the undersigned's knowledge and belief, the property is in the possession of RAYMOND SCOTT LOWERY, and is subject to outstanding ad valorem taxes, outstanding prior liens, street improvements, easements or restrictions of record, if any. The undersigned will execute a Deed to the purchaser at said sale, as provided in the Deed to Secure Debt.
