NOTICE OF SALE STATE OF GEORGIACOUNTY OF MITCHELL By virtue of the power of sale conferred upon the undersigned FAMILY BANK, grantee in that certain security deed, dated February 28, 2007, recorded in Deed Book 842, page 041, in the Office of the Clerk of Superior Court of Mitchell County, Georgia, wherein YANCEY S. HOWELL and KELLY LEE HOWELL a/k/a KELLY L. EDWARDS is the grantor, such power of sale having become operative in consequence of grantor failure to pay the therein mentioned indebtedness in accordance with the terms agreed upon, the undersigned has elected to declare the entire amount due and payable and will, at the Courthouse door in Mitchell County, Georgia on the 1st Tuesday in February, 2013, sell at public outcry to the highest bidder for cash, between the legal hours of sale the property described in said aforesaid security deed described as follows: All that tract or parcel of land lying and being in Land Lot 95 of the 11th Land District of Mitchell County, Georgia, containing 9.356 acres, more or less, and being more fully described as follows: COMMENCE at the intersection of the northerly right of way margin of Mount Olive Road with the westerly right of way margin of Timberwalk Road, at an iron pin set, being the POINT OF BEGINNING of the tract herein described, run thence North 01 degree 07 minutes 54 seconds East 252.04 feet to an iron pin set, run thence South 84 degrees 24 minutes 47 seconds West 184.87 feet to an iron pin set, run thence South 01 degree 32 minutes 05 seconds West 249.96 feet to an iron pin found on the northerly right of way margin of said Mount Olive Road, run thence South 84 degrees 09 minutes 59 seconds West along said right of way margin a chord distance of 236.64 feet to a point, run thence South 83 degrees 54 minutes 50 seconds West along said right of way margin 132.98 feet to a point, run thence North 08 degrees 01 minutes 35 seconds West 782.50 feet to an iron pin set on a fence line, run thence South 87 degrees 57 minutes 40 seconds East along said fence line 134.99 feet to an iron pin set, continue along said fence line South 88 degrees 10 minutes 14 seconds East 545.66 feet to an iron pin set on the east boundary line of said Land Lot 95, also situated on the westerly right of way margin of Timberwalk Road, run thence South 01 degree 37 minutes 39 seconds West along said boundary line and right of way margin 446.77 feet to a point, run thence South 01 degree 07 minutes 54 seconds West 254.04 feet to the Point of Beginning of the tract herein described. Said tract of parcel of land being more fully shown and delineated pursuant to plat of survey prepared by Leroy R. Hall, Registered Land Surveyor, dated December, 2000, being Tract #4, said plat expressly incorporated herein and made a part thereof. Upon completion of sale, the undersigned will execute conveyance to the purchaser by virtue of the power of attorney in said deed, the proceeds from said sale to be used first to pay the indebtedness owing grantee by said grantor, attorney fees in accordance with notice given, the expense of the sale and the balance, if any, to said grantor.
