NOTICE OF SALE<br /><br />STATE OF GEORGIA, COUNTY OF BULLOCH<br /><br /> Under and by virtue of the Power of Sale in that certain Deed to Secure Debt from Club Holdings, Inc., as Grantor, to Farmers and Merchants Bank, as Grantee, dated April 27, 2006, recorded in Deed Book 415, Pages 705-711, Elbert County Records, which Deed to Secure Debt secures (a) a note from Grantor to Grantee dated September 15, 2007, in the original principal sum of $311,488.50; (b) a note from Clubhouse Investments, Inc. to Grantee dated October 30, 2009, in the original principal sum of $162,458.25; and (c) a note from Grantor to Grantee dated March 26, 2004, in the original principal sum of $161,500.00; there will be sold by the undersigned at public outcry, during the legal hours of sale, before the door of the Courthouse in Elbert County, Georgia, on the first Tuesday of September, 2012, to the highest bidder for cash, the following described real property:<br /><br /> ALL that tract or parcel of land situate, lying and being in Elbert County, City of Elberton, State of Georgia, G.M.D. 189, and being more particularly described as follows:<br /><br /> BEGINNING at an iron pin corner on the Northeast right-of-way of Lower Heard Street (100 right-of-way), at a point which is 150.0 feet Southeast as measured along said right-of-way from the intersection of the Northeast right-of-way of Lower Heard Street with the Southeast right-of-way of Harmony Drive (40 right-of-way); thence running North 45 degrees 14 minutes East a distance of 200.6 feet to an iron pin corner; thence running South 39 degrees 58 minutes East a distance of 159.6 feet to an iron pin corner; thence running South 51 degrees 33 minutes West a distance of 200.00 feet to an iron pin corner on the Northeast right-of-way of Lower Heard Street; thence running along the Northeast right-of-way of Lower Heard Street North 39 degrees 58 minutes West a distance of 137.5 feet to the iron pin point of beginning, and being known and designated as Tract Number 4 and Tract Number 1-A on Survey for Huddle House, Inc., dated December 29, 1992, certified by Clelland A. Tyson, G.R.L.S. Number 1515.<br /><br /> The debt secured by said Deed to Secure Debt has been and is hereby declared due and payable in full because of non-payment thereof pursuant to the terms of said Deed to Secure Debt and notes. The debt remaining in default, this sale will be made for the purpose of paying said indebtedness, including all interest and attorney fees and all expenses of sale, and any other obligations of the Grantor to the Grantee.<br /><br /> Said property will be sold as the property of Clubhouse Investments, Inc., successor by merger to Club Holdings, Inc., and to the best knowledge and belief of the undersigned, the property is in the possession of Clubhouse Investments, Inc. or its tenants. Said property will be sold subject to any and all unpaid taxes, assessments, prior encumbrances, general subdivision restrictions, and other restrictions and easements of record, if any. The undersigned will execute a deed to the purchaser as authorized by the aforesaid Deed to Secure Debt.<br /><br /> Pursuant to O.C.G.A.
