NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in a Deed to Secure Debt by Jacqueline S. Rhyme to CitiFinancial Services, Inc., dated October 28, 2005 and filed for record December 2, 2005 in Deed Book 7-Y, Page 1, Terrell County, Georgia records, and securing a Note in the original principal amount of $65,079.31; there will be sold at a public outcry for cash to the highest bidder before the Courthouse door of Terrell County, Georgia, between the legal hours of sale on the first Tuesday in September, 2012, by CitiFinancial Services, Inc. as Attorney-in-Fact for Jacqueline S. Rhyme the following property to-wit:
ALL THAT TRACT or parcel of land situated, lying and being in the City of Bronwood, Terrell County, Georgia, and being a portion of lot of Land No. 137 in the 12th Land District in said City, and containing 0.273 acres, and being more particularly described as follows:
TO FIND THE point of beginning commence at the southwest intersection of North Johnson Street and Pecan Street in the City of Bronwood, and from said point of intersection, thence go south 66 degrees 58 minutes west for a distance of 231.20 feet along the south right of way of Pecan Street to an iron pin; thence go south 9 degrees 23 minutes east a distance of 152.93 feet to an iron pin; thence go south 66 degrees 01 minutes west for a distance of 80 feet; thence go north 9 degrees 30 minutes west a distance of 154.17 feet to an iron pin located on the south right of way of Pecan Street; thence go north 66 degrees 58 minutes east for a distance of 80 feet to an iron pin and the point of beginning. The herein conveyed property being more particularly described by that certain plat of survey, drawn by Marbury Engineering Company, under date of April 13, 1982, entitled "Property of Donald F. McNell," and being recorded in Plat Book 4, Page 402 in the Office of the Clerk of Superior Court of Terrell County, Georgia, and said plat, survey and record thereof are by express reference thereto incorporated herein for a more complete description of the property.
WITH ALL RIGHTS, members and appurtenances to the said described premises in anywise appertaining or belonging.
The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees, if applicable.
The property will be sold as the property of the aforesaid grantor subject to the following: all prior restrictive covenants, easements, rights-of-way, security deeds, or encumbrances of record; all valid zoning ordinances; matters which would be disclosed by an accurate survey of the property or by any inspection of the property; all outstanding taxes, assessments, unpaid bills, charges, and expenses that are a lien against the property whether due and payable or not yet due and payable.

The foregoing notwithstanding, nothing in O.C.G.A. 44-14-162.2 shall be construed to require CitiFinancial Services, Inc. to negotiate, amend or modify the terms of the Deed to Secure Debt described herein.
