By virtue of the power of sale contained in the Deed to Secure Debt from Phillip Michael Edenfield and Mary A. Edenfield to The Merchants & Citizens Bank, dated August 4, 2005, recorded in Deed Book 14-R, pages 514-518, in the Office of the Clerk of Superior Court of Telfair County, Georgia, conveying the property described hereinafter to secure a Note in the original principal amount of $25,734.28 with interest thereon as set forth therein, for a total amount of $23,213.46 (as of October 1, 2012) being due, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Telfair County, McRae, Georgia, during the legal hours of sale on the first Tuesday in December, 2012, the following described property, to-wit:

All that tract or parcel of land situate, lying and being in Land Lot Number 129 in the 10th Land District of Telfair County, Georgia, containing 2.16 acres, more or less, and being more particularly shown and described and having the metes, bounds and dimensions as shown by that certain plat of survey entitled urvey for Rufus and Marleen Milligan prepared by Jimmy M. Bloodworth, Georgia Registered Land Surveyor #1828, dated July 10, 1982, and recorded in Plat Book 5, page 356, Clerk Office, Telfair Superior Court, Telfair County, Georgia, which said plat and its record thereof are by reference incorporated herein for descriptive and all other legal purposes. Said property is further described as being bounded, now or formerly, as follows: On the Northwest by lands of D. E. and Peggy McLean; on the Northeast by an old fence running along the Northeast original Land Lot Line of said Land Lot separating from lands of Smith; on the Southeast by lands of Rabun Beasley; and on the Southwest by the Northeasternmost right of way boundary of that 60 foot road which bounds said property and is shown on said plat above referenced. Said lands are the identical lands described in and conveyed by that certain deed from Rabun Beasley to Rufus Milligan and Marleen A. Milligan, dated June 21, 1982, and recorded in Deed Book 7-A, Page 522, Telfair County Records.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of non-payment of the indebtedness when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Deed to Secure Debt and by law, including attorney fees, notice of intent to collect attorney fee having been given.

Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is Mary A. Edenfield and Phillip Michael Edenfield, or a tenant or tenants, and said property commonly has an address of 42 Blankenship Road, McRae, Georgia 31055.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
