UNDER POWER

Georgia, Telfair County

By virtue of the power of sale contained in the Deed to Secure Debt from Marion Hames to Merchants & Citizens Bank, dated April 13, 2001, recorded in Deed Book 12-D, pages 79-83, Telfair County Records, conveying the property described hereinafter to secure Note in the original principal amount of $6,040.00, with interest thereon as set forth therein, on the unpaid balance, for a total amount of $5,674.85 (as of September 28, 2012) being due, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Telfair County, Georgia, during the legal hours of sale on the first Tuesday of December, 2012, the following described property, to-wit:

All that tract or parcel of land lying and being in the City of McRae, Telfair County, Georgia, being described by metes and bounds as follows: Beginning at a stake in the property line on the West side of Second Avenue, corner to property now or formerly owned by Lou Oliver and running thence in a Westerly direction, along the line of said Lou Oliver property 112 feet to a stake; thence leaving the said Lou Oliver property and running in a Southerly direction, parallel to Second Avenue a distance of 75 feet to a stake in the line of property now or formerly owned by Hick Lawson; thence running in an Easterly direction, along the line of said Hick Lawson property a distance of 112 feet to a stake corner to the Hick Lawson property in the property line on the West side of Second Avenue; thence running in a Northerly direction, along the property line on the West side of Second Avenue a distance of 75 feet to the Beginning. Said lands are the identical lands described in and conveyed by that certain deed from Andrew Norwood to Ella Mae Wright Norwood, dated July 30, 1970, recorded in Deed Book 5-I, page 292, n the Office of the Clerk of Superior Court of Telfair County, Georgia. Said lands are further a portion of the lands shown and delineated in that certain plat of survey by Southern Surveying Associates, dated August 27, 1999, which plat, recorded in Plat Book 9, page 195, in the Office of the Clerk of Superior Court of Telfair County, Georgia, is by reference incorporated herein and made a part hereof. Said lands are further a portion of the lands described in and conveyed by that certain deed from Ella Mae Wright Norwood to Ella Mae Wright Norwood, dated September 17, 1999, recorded in Deed Book 11-E, pages 305-306, in the office of the Clerk of Superior Court of Telfair County, Georgia.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of non-payment of the indebtedness when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Deed to Secure Debt and by law, including attorney fees, notice of intent to collect attorney fee having been given.

Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is Marion Hames, or a tenant or tenants, and said property commonly has an address of 59 N. Second Avenue, McRae, Georgia 31055.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
