By virtue of the power of sale contained in a Deed to Secure Debt by Susan R. Tompkins to Mortgage Electronic Registration Systems, Inc. ("MERS"), as nominee for Taylor, Bean & Whitaker Mortgage Corp., dated November 17, 2006, and filed for record November 22, 2006, in Deed Book 516, Page 343, as supplemented by that certain Attestation Affidavit, filed 10/01/2012 in Deed Book 595, Page 611, Tattnall County, Georgia records, and securing a Note in the original principal amount of $98,838.00; last transferred to BAC Home Loans Servicing, LP, FKA Countrywide Homes Loans Servicing, LP, by Assignment, filed for record in Deed Book 575, Page 173, Tattnall County, Georgia records, there will be sold at a public outcry for cash to the highest bidder before the Courthouse door of Tattnall County, Georgia, between the legal hours of sale on the first Tuesday in December, 2012, by Bank of America, N.A., Successor by Merger to BAC Home Loans Servicing, LP, FKA Countrywide Home Loans Servicing, LP, as Attorney-in-Fact for Susan R. Tompkins, the following property to-wit:
All that certain tract or parcel of land, situate, lying, and being in the City of Glennville, 1432nd G.M. District of Tattnall County, Georgia, containing 0.492 of an acre, and being designated as Lots 2B and 3A of Lakeview Estates Subdivision, Phase 1, and being bounded as follows: Northeasterly by Lot 3B, said phase and subdivision; Southeasterly by Lot 11, said phase and subdivision; Southwesterly by Lot 2A, said phase and subdivision; and Northwesterly by Dogwood Street. Said property is more definitely and accurately described according to a plat thereof made by Princeton P. Pirkle, Jr., GA Reg. Land Surveyor No. 1474, dated April 26, 1994, and recorded in the office of the Superior Court of Tattnall County, Georgia, in Plat Book 13, Page 129, reference being hereby made thereto for descriptive and for all other purposes.
The above described property is also known as 108 Dogwood Street, Glennville, GA 30427-2736.
The indebtedness secured by said Deed to Secure Debt, having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees, if applicable.
The property will be sold as the property of the aforesaid grantor subject to the following: all prior restrictive covenants, easements, rights-of-way, security deeds, or encumbrances of record; all valid zoning ordinances; matters that would be disclosed by an accurate survey of the property or by any inspection of the property; all outstanding taxes, assessments, unpaid bills, charges, and expenses that are a lien against the property whether due and payable or not yet due and payable.
