NOTICE OF SALE UNDER POWER

By virtue of the power of sale contained in a Deed to Secure Debt by HERMAN K THOMAS to CitiFinancial Services, Inc., dated February 21, 2008 and filed for record February 22, 2008 in Deed Book 714, Page 94, Jones County, Georgia records, and securing a Note in the original principal amount of $95,694.31; last transferred to Citifinancial, Inc., a Maryland corporation by Assignment, filed for record in Deed Book 828, Page 516, Jones County, Georgia records, there will be sold at a public outcry for cash to the highest bidder before the Courthouse door of Jones County, Georgia, between the legal hours of sale on the first Tuesday in December, 2012, by CitiFinancial, Inc. a Maryland Corporation as Attorney-in-Fact for HERMAN K THOMAS the following property to-wit:

ALL THE FOLLOWING DESCRIBED REAL ESTATE, TO-WIT: ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 77 of the 7th Land District of Jones County, Georgia, shown as Lot 5 of Roundtree Subdivision on a plat prepared by Jesse Collins, Jr., Georgia Registered Land Surveyor No. 2085, dated August 1, 1983, and recorded in Plat Book 7, Page 247, of the Real Estate Records of the Jones County, Georgia, Superior Court Clerk`s Office.

Being the same Fee Simple property conveyed to Herman K. Thomas and Eloise J. Thomas from Rauls Convalescent Home, Inc., by deed dated 04/26/1984, recorded on 04/30/1984 in Book 187, Page 652. The interest of the said by deed from Eloise J. Thomas having conveyed to the said Herman K. Thomas, dated 02/11/1999 recorded on 03/09/1999 in Book 374, Page 137 in Jones County Records, State of GA.

The above described property is also known as 464 JOYCLIFF TERRACE, MACON, GA 31211.

The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney s fees, if applicable.

The property will be sold as the property of the aforesaid grantor subject to the following: all prior restrictive covenants, easements, rights-of-way, security deeds, or encumbrances of record; all valid zoning ordinances; matters which would be disclosed by an accurate survey of the property or by any inspection of the property; all outstanding taxes, assessments, unpaid bills, charges, and expenses that are a lien against the property whether due and payable or not yet due and payable.
