NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in a Deed to Secure Debt by EUGENE K. BARNETT to CitiFinancial Services, Inc., dated November 17, 2003 and filed for record November 19, 2003 in Deed Book 714, Page 101, Oconee County, Georgia records, as supplemented by that certain Affidavit recorded September 10, 2012 in Deed Book 1155, Page 784 Oconee County, Georgia records, and securing a Note in the original principal amount of $127,768.16; last transferred to Citifinancial, Inc., a Maryland corporation by Assignment, filed for record in Deed Book 1154, Page 601, Oconee County, Georgia records, there will be sold at a public outcry for cash to the highest bidder before the Courthouse door of Oconee County, Georgia, between the legal hours of sale on the first Tuesday in February, 2013, by CitiFinancial, Inc. a Maryland Corporation as Attorney-in-Fact for EUGENE K. BARNETT the following property to-wit:
ALL THAT TRACT or parcel of land, and improvements thereon, situate, lying and being in Oconee County, Georgia, and which said land is more fully described in a deed from Maybelle M. Porter to Grantor herein dated January 14, 1958 and recorded in the records of the clerk of the Superior Court of Oconee County, Georgia, in Deed Book FF, Page 367 and which said description is incorporated herein by reference.
BEING MORE FULLY described in a deed dated 04/17/1987 and recorded 04/21/1987, among the land records of the county and state set forth above, in Book 87, Page 176.
The above described property is also known as 6301 HIGH SHOALS ROAD, BISHOP, GA 30621.
The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees, if applicable.
The property will be sold as the property of the aforesaid grantor subject to the following: all prior restrictive covenants, easements, rights-of-way, security deeds, or encumbrances of record; all valid zoning ordinances; matters which would be disclosed by an accurate survey of the property or by any inspection of the property; ll outstanding taxes, assessments, unpaid bills, charges, and expenses that are a lien against the property whether due and payable or not yet due and payable.
