Because of default in the payment of the indebtedness, secured by a Security Deed executed by Stephen M. Shirlock to Mortgage Electronic Registration Systems, Inc. as nominee for Calusa Investments, LLC, its successors and assigns dated August 30, 2006 in the amount of $176,200.00, and recorded in Deed Book 928, Page 472, Colquitt County, Georgia Records; as last transferred to HSBC Mortgage Services Inc. by assignment; the undersigned, HSBC Mortgage Services Inc. pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in September, 2012 , during the legal hours of sale, at the Courthouse door in Colquitt County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:



All that tract or parcel of land lying and being in Colquitt County, Georgia and being described as follows: All that tract or parcel of land situate, lying and being in Land Lot 385 in the 8th Land District of Colquitt County, Georgia and being part of Lot 7 and part of Lot 8 in Block 5 in the Riverwood Subdivision, and being more particularly described as follows: From the Southeast corner of Lot 8 at its intersection with the Western margin of the Right of Way of Bull Creek Road, run thence North 35 Degrees 23 Minutes 00 Seconds West a distance of 205.00 feet to a point; run thence in a Southwesterly direction a distance of 192.55 feet to a point which is South 20 Degrees 17 Minutes 00 Seconds East 8.62 feet from the Northwest corner of Lot 8; continue thence South 20 Degrees 17 Minutes 00 Seconds East a distance of 191.38 feet to the Southwest corner of Lot 8; run thence North 69 Degrees 00 Minutes 00 Seconds East a distance of 245.72 feet to the Point of Beginning. Being the same property conveyed to Stephen M. Shirlock by deed from KRW Enterprises, L.L.C, recorded 09/05/2002 in Deed Book 762 Page 666, in the Office of the Clerk of the Superior Court of Colquitt County, Georgia. which has the property address of 108 Bull Creek Road, Moultrie, Georgia., together with all fixtures and other personal property conveyed by said deed.



The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property.



The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.



Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed.



Said property will be sold as the property of Stephen M. Shirlock and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
