Under and by virtue of the Power of Sale contained in a Security Deed given by Daniel Baptiste Wilson and Amber Nicole Wilson to Mortgage Electronic Registration Systems, Inc. as nominee for SunTrust Mortgage, Inc., dated December 29, 2006, recorded in Deed Book 1363, Page 320, Thomas County, Georgia Records, as last transferred to SunTrust Mortgage, Inc. by assignment recorded in Deed Book 1766, Page 339, Thomas County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of NINETY-NINE THOUSAND AND 0/100 DOLLARS ($99,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Thomas County, Georgia within the legal hours of sale on the first Tuesday in August, 2012, the following described property:
All that lot, tract or parcel of land situate, lying and being in Land Lot #200 in the 18th Land District of Thomas County, Georgia, and being all of the northwest half of Lot No. 12 in Block A and 50 feet lying northwest of Lot No. 12 in Block A as shown by a plat of "Survey of Block A & B in Original Land Lot No. 200 in the 18th District, " made by W.H. Thames, Surveyor License No. 93, dated September 4, 1963, and recorded in Deed Book 7, Page 428 in the Office of the Clerk of the Superior Court of Thomas County, Georgia, more particularly described as follows:
Commence at the corner formed by the intersection of the southwest margin of Cindy Drive with the northwest margin of the right-of-way of U.S. Highway No. 319 and run thence north 48 degrees 30 minutes west on said margin of Cindy Drive 951 feet to a point as the point of beginning; from said point of beginning run thence south 41 degrees 30 minutes west 300 feet to a point; run thence north 48 degrees 30 minutes west 100 feet to a point; run tehnce north 41 degrees 30 minutes east 300 feet to the southwest margin of Cindy Drive extended; run thence south 48 degrees 30 minutes east on said margin of Cindy Drive 100 feet to the point of beginning. The above described property is conveyed subject to those restrictions as shown in a Warranty Deed from R.C. Ausley to Mrs. R.M. Parrish, dated February 28, 1967 and of record in Deed Book 31, Page 512, Deed Records of Thomas County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed.
The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). To the best knowledge and belief of the undersigned, the party in possession of the property is Daniel Baptiste Wilson and Amber Nicole Wilson or a tenant or tenants and said property is more commonly known as 209 Cindy Dr, Thomasville, Georgia 31792.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
