Under and by virtue of the Power of Sale contained in a Security Deed given by Chadrick L Smith to Mortgage Electronic Registration Systems, Inc., dated January 14, 2009, recorded in Deed Book 1542, Page 230, Thomas County, Georgia Records, as last transferred to BAC Home Loans Servicing, LP fka Countrywide Home Loans Servicing, LP by assignment recorded in Deed Book 1647, Page 128, Thomas County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED NINETY-SEVEN THOUSAND TWO HUNDRED NINETY-THREE AND 0/100 DOLLARS ($197,293.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Thomas County, Georgia within the legal hours of sale on the first Tuesday in August, 2012, the following described property: SEE EXHIBIT A ATTACHED HERETO AND MADE A PART HEREOF



The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. All that tract or parcel of land situate, lying and being in Land Lot 82 of the 13th Land District, Thomas County, Georgia, being identified as Lot 50 of Jordan Oaks Subdivision, Phase I, as depicted on that plat of survey for Jordan Oaks Subdivision, Phase I, prepared by Barbara L. Herring, Georgia Registered Land Surveyor No. 2785, dated July 5, 2007, and recorded on July 11, 2007, in Plat Cabinet 4, Folio 181-B in the deed records for Thomas County, Georgia, reference to which plat is made for a more particular description of the subject properties by metes and bounds and courses and distances as set forth thereon. The above-described properties are conveyed subject to the following: 1. Restrictive Covenants Deed for Mitigation Stream Buffer Ares (23,000 Square feet, dated and recorded July 17, 2007, in Deed Book 1419, Pages 268-271, of the deed records of Thomas County, Georgia. 2. The Jordan Oaks Subdivision declaration of restrictions, covenants and conditions ("Restrictions"), dated July 17, 2007, and recorded on July 17, 2007, in Deed Book 1419, Pages 272-298, of the deed records of Thomas County, Georgia; and the privileges and duties of membership in the Jordan Oaks Homeowners Association, Inc. 3. The easements, setbacks, common areas and other items depicted on the above referenced plat, as described in the above-referenced restrictions. 4. The grantee complying with all the requirements of the State of Georgia, Department of Natural Resources, General Permit GAR 10003, regulating the discharge of storm water associated with constructing activity on the subject properties. By accepting this conveyance, grantee agrees to comply with grantor's erosion, sedimentation and pollutant control plan (plan) to the extent the pan applies to the subject properties, and to indemnify grantor against liability for compliance with any requirement of the Georgia Department of Natural Resources, Southwest District Office, Albany, Georgia, pertaining to these properties, and to execute the notice of intent for coverage under general Permit GAR 10003, as secondary permittee as required by the Georgia Environmental Protection Division and to comply with the Georgia Soil and Water Best Management Practices (BMP) applicable to the subject properties.
