THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by William F. Hightower, Jr. and Beverly W. Hightower to Mortgage Electronic Registrations Systems, Inc. as nominee for Opteum Financial Services, LLC, it's successors and assigns , dated January 20, 2006, recorded in Deed Book 1265, Page 269, Thomas County, Georgia Records and as re-recorded in Deed Book 1732, Page 312, Thomas County, Georgia Records, as last transferred to JPMorgan Chase Bank, National Association by assignment recorded in Deed Book 1803, Page 246, Thomas County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED NINETY-FOUR THOUSAND AND 0/100 DOLLARS ($194,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Thomas County, Georgia within the legal hours of sale on the first Tuesday in March, 2013, the following described property:



All that tract or parcel of land situate, lying and being in Land Lot 146 of the 13th Land District of Thomas County, Georgia, being identified as Lot 40 of Ivy Hill Subdivision, Phase I, as shown on a plat of survey of said Subdivision prepared by Leroy Ouzts, Georgia Registered Land Surveyor 1654, dated March 9, 1994, revised May 19, 1994, and of record in Plat Cabinet 2, Folio 102-D among the Deed Records of Thomas County, Georgia.



The above described property is conveyed subject to the following: 1) Protective Covenants dated January 10, 1994, and of record in Deed Book 415, Page 348-353, of the Deed Records of Thomas County, Georgia; and 2) drainage easements, utility easements, and building setback lines as shown on the above referenced plat of survey. The above referenced property is also conveyed subject to that Drainage Easement from Karl Weckwert to Thomas County, Georgia, dated November 25, 1997, and recorded in Deed Book 603, Page 392 of the Deed Records of Thomas County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). JPMorgan Chase Bank, National Association holds the Note and Security Deed to the above-referenced property and services the above-referenced loan on behalf of the current owner of the loan: Federal National Mortgage Association (Fannie Mae). To the best knowledge and belief of the undersigned, the party in possession of the property is William F. Hightower, Jr. and Beverly W. Hightower or a tenant or tenants and said property is more commonly known as 75 Sunrise Circle, Thomasville, Georgia 31757.



The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
