NOTICE OF SALE
GEORGIA, TIFT COUNTY
Because of default in the payment of the indebtedness, secured by a Security Deed executed by Robert Eickenhorst to Mortgage Electronic Registration Systems, Inc. as nominee for First Magnus Financial Corporation, its successors and assigns dated May 16, 2005 in the amount of $102,600.00, and recorded in Deed Book 1194, Page 139, Tift County, Georgia Records; as last transferred to Deutsche Bank National Trust Company, solely as Trustee for MASTR Specialized loan Trust 2006-1 Mortgage Pass-Through Certificates, Series 2006-1 by assignment; the undersigned, Deutsche Bank National Trust Company, solely as Trustee for MASTR Specialized loan Trust 2006-1 Mortgage Pass-Through Certificates, Series 2006-1 pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in December, 2012 , during the legal hours of sale, at the Courthouse door in Tift County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:
All that tract or parcel of land lying and being Lots 2 and 3 of the E.O. Rutland Subdivision located in Land Lot 294, 6th Land District, Tift County, Georgia, being more particularly described as follows: To find the Point of Beginning, commence at the intersection of the North land lot line of Land Lot 294 with West Right-of-Way line of Rutland Road (60 foot Right of Way) and run thence along the West Right of Way line of Rutland Road South 35 degrees 12 minutes 27 seconds East 444.90 feet; thence continue along the West Right of Way line of Rutland Road along a curve an arc distance of 179.86 feet (said arc being subtended by a chord having a bearing of South 28 degrees 40 minutes 23 seconds East, a distance of 179.48 feet, and a radius of 788.51 feet) to the Point and Place of Beginning; thence from such beginning point, continue thence along the West Right of Way line of Rutland Road and along a curve an arc distance of 132.62 feet (said arc being subtended by a chord having a bearing of South 17 degrees 19 minutes 11 seconds East a distance of 132.47 feet, and a radius of 788.51 feet); continue thence along the West Right of Way line of Rutland Road along a curve an arc distance of 132.92 feet (said curve being subtended by a chord having a bearing of South 7 degrees 40 minutes 20 seconds East, a distance of 132.76 feet and a radius of 788.51 feet); thence run South 84 degrees 55 minutes 25 seconds West a distance of 179.65 feet; thence run North 0 degrees 54 minutes 56 seconds West a distance of 112.68 feet; thence run North 01 degrees 14 minutes 00 seconds West a distance of 127.40 feet; thence run North 74 degrees 59 minutes 0 seconds East a distance of 130.80 feet to a point on the West Right of Way line of Rutland Road and the Point and Place of Beginning of the description herein delineated. Said tract of land is more particularly shown and delineated according to a plat of survey prepared for Rollie Dale Delk and Sandra Jo Delk by Hampton and Associates Surveying Co. dated February 10, 1992, and recorded in Plat Book 22, Page 85, public records, Tift County, Georgia; said plat and the description thereon being incorporated into this description by reference thereto.
which has the property address of 806 Rutland Road, Tifton, Georgia., together with all fixtures and other personal property conveyed by said deed.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed. Notice has been also given, in writing and by certified mail, return receipt requested, to the borrower, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a).
Said property will be sold as the property of Robert Eickenhorst and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
