NOTICE OF SALE UNDER POWER GEORGIA, MUSCOGEE COUNTY Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by Eric J. Clark and Jaime L. Clark to Walter Mortgage Company, LLC, dated June 24, 2011 and recorded on July 18, 2011, in Deed Book 10327, Page 138, in the Office of the Clerk of Superior Court for Muscogee County, Georgia, in said clerk's office, conveying the after described property to secure a Note for the original indebtedness, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Muscogee County, Georgia, within the legal hours of sale on the first Wednesday in November, 2013 the following described property: All that lot, tract or parcel of land, situate, lying and being in Muscogee County, Georgia, and being part of the Northeast part of Coweta Reserve Lot #113 in said State and County, and being more particularly described as follows: Beginning at a point on the East line of said Lot #113, which point is 310 feet South from the Northeast corner of said lot and extending thence South along the East line of said lot a distance of 50 feet; extending thence West at right angles with said East line a distance of 157 1/2 feet; extending thence North along the line parallel with said East line of said lot a distance of 50 feet; extending thence East a distance of 157 1/2 feet to the point of beginning to East line of said lot. Also, that certain tract of land, situate lying and being in Land Lot #113, in the Coweta Reserve, said tract of land being more particularly described as follows:Beginning at a point on the East side of Lot 113, said beginning point being 260 feet South of the Northeast corner of Land Lot 113, extending thence South 50 feet to the Northeast corner of lot of Nettie Seay, thence running West a distance of 157 1/2 feet; extending thence North a distance of 50 feet; extending thence East a distance of 157 1/2 feet to the point of beginning. This conveyance is made subject to the covenants and easements of record in the Office of said Clerk; and said property is subject to the applicable provisions of The Zoning Ordinances of the City of Columbus. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney's fees, notice of intent to collect attorney's fees having been given. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above, the same having been assigned by Walter Mortgage Company, LLC to Walter Investment Management Corp., and further to Green Tree Servicing LLC.
