Under and by virtue of the Power of Sale contained in a Security Deed given by JUAN VIGIL and MARIA L. VIGIL to World Savings Bank, FSB, dated March 15, 2007, recorded in Deed Book 814, Page 144, Toombs County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of SEVENTY THOU- SAND AND 0/100 DOLLARS ($70,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the court- house door of Toombs County, Georgia within the legal hours of sale on the first Tuesday in December, 2012, the following described property:

All that certain land situated in the State of GA, County of Toombs, City of Vidalia, described as follows: All that certain tract or parcel of land situate, lying and being in the City of Vidalia, 51st G.M. District of Toombs County, Georgia, being known and designated as Lot 12 in Block E of the Crimson Crest Subdivision. Said property being bounded generally, now or formerly, as follows, to-wit: On the North by the Southernmost margin of the right-of-way of Grossman Drive; on the East by Lot 11 of said Block and said subdivision; on the South by Lot 1 of said Block and said Sub- division; and on the West by Lot 13 of said Block and said Subdivision. Said property being more particularly described as shown on that certain plat of survey pre- pared by Charles M. Zeigler and Asso- ciates, dated August 4, 1988, and incorpo- rated herein and made a part and parcel of this description.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner pro- vided in the Note and Security Deed.

The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as pro- vided in Security Deed and by law, includ- ing attorney s fees (notice of intent to col- lect attorney s fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be dis- closed by an accurate survey and inspec- tion of the property, any assessments, li- ens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

Wells Fargo Bank, N.A. successor by merger to Wachovia Mortgage, FSB, for- merly known as World Savings Bank, FSB is the holder of the Note and Security Deed to the property in accordance with OCGA 44-14-162.2. The entity that has full au- thority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Wells Fargo Home Mortgage a div. of Wells Fargo Bank, N.A., 4101 Wiseman Blvd, San Antonio, TX 78251, 800-282- 3458. To the best knowledge and belief of the undersigned, the party in possession of the property is Juan Vigil and Maria L. Vigil or a tenant or tenants and said property is more commonly known as 1320 N GROSSMAN DR, VIDALIA, GEORGIA 30474.

The sale will be conducted subject (1) to confirmation that the sale is not prohibit- ed under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.

This law firm is seeking solely to fore- close the creditor s lien on real estate and this law firm will not be seeking a personal money judgment against you.
