NOTICE OF SALE UNDER POWER
WHEREAS, for value received, Gary Wells executed and delivered to the United States of America, acting through the United States Department of Agriculture, two Deeds to Secure Debt conveying certain real estate located in Jefferson County, Georgia, and said Deeds to Secure Debt were recorded in the office of the Clerk of Superior Court for Jefferson County, Georgia as follows:

WHEREAS, the United States of America now holds the above described security deeds covering the said real estate;
WHEREAS, the Deeds to Secure Debt held by the United States of America provide that should default occur, the holder may declare the entire indebtedness secured by the Deeds to Secure Debt due and payable and, in compliance with the power of sale provisions contained in said security deeds proceed to sell the property at public outcry; and
WHEREAS, after default, the United States of America has declared all of the indebtedness secured by the Deeds to Secure Debt due and payable and hereby certifies that it has complied with all of its loan servicing regulations. Inquiries regarding this sale should be directed to the Farm Service Agency, 355 East Hancock Avenue, Stop 104, Athens, Georgia, 30601-2775, Telephone Number (706) 546-2166.
NOW, THEREFORE, the said United States of America, acting as aforesaid, under and in compliance with the power of sale provision contained in the Deeds to Secure Debt, will proceed to sell at public outcry, for cash or certified funds to the highest bidder in front of the Courthouse in Jefferson County, during the legal hours of sale, on the 5th day of February , 2013, the following-described property conveyed in the Deeds to Secure Debt, to Wit:

The above described property will be sold subject to any and all outstanding real estate taxes that are due and payable.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the United States of America, be cause for rejection of the bid, and, if the bid is rejected, the United States of America shall have the option of making the sale to the next highest bidder who is ready, willing and able to comply with the terms thereof.
The proceeds of said sale will first be applied to the payment of the indebtedness to the United States of America, other charges and the expenses of sale, as provided in the above-described Deeds to Secure Debt.

All that tract or parcel of land together with all improvements thereon, situate, lying and being in the 79th District G.M., Jefferson County, Georgia, containing 138 acres, more or less, formerly known as the homeplace of Mrs. Jewell A. Watkins, and bounded now or formerly as follows: on the North by lands of Continental Can Company, being separated therefrom by Gin Branch; on the East by the right of way of Georgia Highway #88; on the South by lands Howard Dixon and Gin Branch. This is the same tract of land described in Warranty Deed from Mrs. Jewell A. Watkins to Rodney D. Giesbrecht and Verle K. Giesbrecht dated October 15, 1976, and recorded in the office of the Clerk of the Superior Court of Jefferson County, Georgia, in Deed Book 111, page 580. The aforesaid 138 acre tract of land is composed of two smaller adjacent tracts of land, one of which containing 40.1 acres, and being more fully described and set forth on a plat prepared by D.J. May, C.S. of G.C., dated July 31st and August 1, 1941, and recorded in the office of the aforesaid clerk in Deed book 3-G on page 331; and the other containing 104.56 acres, and being more fully described and set forth on a plat prepared by D.J. May, C.S. of G.C., dated July 31st and August 1, 1941, and recorded in the office of the aforesaid clerk in Deed Book 77 on page 160; less and excepting from both said plats the 8,028 acre strip of land more fully described and set forth in right of way Deed with plat attached from Mrs. Jewell Watkins to Jefferson County, Georgia, dated August 1, 1962, recorded in the office of the aforesaid clerk in Deed Book 65 on page 144.
