Under and by virtue of the Power of Sale contained in a Security Deed given by Donald E Mills and Margaret Grace Mills to Mortgage Electronic Registration Systems Inc. as nominee for Suntrust Mortgage Inc., dated December 22, 2004, recorded in Deed Book 468, Page 419, Butts County, Georgia Records, as last transferred to Deutsche Bank Trust Company Americas As Trustee RALI 2005-QS3 by assignment recorded in Deed Book 712, Page 532, in the Office of the Clerk of Superior Court of Butts County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED SEVENTY-FIVE THOUSAND AND 0/100 DOLLARS ($175,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Butts County, Georgia within the legal hours of sale on the first Tuesday in February, 2013, the following described property:All that tract or parcel of land lying and being in Land Lot 112 of the 1st District of Butts County, Georgia and being more particularly described as follows: Beginning at an iron pin located on the Southerly right of way line of Walt Banks Road (30 foot right of way) which iron pin is located 592.61 feet from the intersection of the centerline of Walt Banks Road and the centerline of McLendon Spur (aka Old Jenkinsburg/High Falls Road) following the curvature thereof an arc distance of 200.83 feet (said arc being subtended by a chord bearing South 86 degrees 40 minutes 34 seconds East with a radius of 273.00 feet and a chord distance of 196.33 feet) to a point; run thence North 68 degrees 35 minutes East 200 Feet to a point; run thence North 72 degrees 05 minutes East 120 feet to a point; run thence North 68 degrees 5 minutes East 73 feet to an iron pin found; thence leaving said right of way, run South 00 degrees 37 minutes West 439.4 feet to an iron pin found; run thence South 89 degrees 10 minutes West 369.2 feet to an iron pin found; run thence South 04 degrees 05 minutes 48 seconds East 180.69 feet to an iron pin; run thence South 05 degrees 21 minutes 00 seconds East 25.00 feet to an iron pin; run thence North 90 degrees 00 minutes 00 seconds West 350.00 feet to an iron pin; run thence North 16 degrees 47 minutes 46 seconds East 528.06 feet to the Point of Beginning. All as shown on two plats of survey one of Property of Woody L. Cox prepared by T.A. Carmichael, dated July 10, 1983, and one on plat of survey prepared for Donald E. Mills by Vaughn & Drake Surveyors, Inc. dated February 10, 2004, Ernie Drake (GRLS No. 741) which survey indicates said tract contains a total of 6.003 acres. Copies of these surveys are attached as Exhibit "B" for a more complete description. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
