NOTICE OF SALE UNDER POWER
GEORGIA, CAMDEN COUNTY
By virtue of the power of sale contained in the Deed to Secure Debt (_Security Deed_) from Emel Erkal, Selcuk Erkal, Aydin Topaloglu, and Alison W. Topaloglu to Ameris Bank, dated April 3, 2008, recorded in the public records of Camden County, Georgia, at Deed Book 1425, Page 809, given to secure a Note dated April 3, 2008, in the original principal amount of $222,199.38, as renewed on March 11, 2011, and as modified on October 3, 2011, there will be sold by the undersigned at public outcry, during the legal hours of sale before the Courthouse door of Camden County, Georgia, on the first Tuesday in October, 2012, to the highest and best bidder for cash, the following described property:
All that lot, tract or parcel of land lying and being in the 1606th G. M. District, Camden County, Georgia, shown and delineated upon a plat of survey prepared for Mission Investment Fund, ELCA, by Batchelor and Associates,
Georgia Registered Land Surveyor No. 2238, dated February 3, 2000, which is recorded in Plat Cabinet 2, page 190-A, Camden County, Georgia, records, and being more particularly described as follows:
Beginning at an iron pin found where the southwesterly 100-foot right-of-way of Colerain Road intersects the eastern variable right-of-way of Wildcat Drive; thence, South 64 18_ East a distance of 500.00 feet to an iron pin set on the southwesterly 100-foot right-of-way of Colerain Road; thence, South 25 42_ West a distance of 649.96 feet to an iron pin set; thence, North 64 18_ West a distance of 444.17 feet to an iron pin set on the easterly 80-foot right-of-way of Wildcat Drive; thence, along a curve to the left having a radius of 308.11 feet and an arc length of 128.47 feet, being subtended by a chord of North 21 18_ East a distance of 127.54 feet to an iron pin found on the easterly 80-foot right-of-way of Wildcat Drive; thence, North 09 36_ East a distance of 443.16 feet to an iron pin found on the easterly 80-foot right-of-way of Wildcat Drive; thence, along the variable right-of-way of Wildcat Drive North 62 12_ East a distance of 120.46 feet to an iron pin found and the point of beginning. Said tract containing 7.5 acres. Reference is made to the aforesaid plat for descriptive and all other legal purposes.
Subject to all valid and enforceable restrictive covenants, reservations and easements if record applicable thereto.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the installments under said Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by said Security Deed, accrued interest and expenses of the sale, including attorney's fees.
To the best of the undersigned's knowledge and belief the property is in the possession of Emel Erkal, Selcuk Erkal, Aydin Topaloglu, and Alison W. Topaloglu and said property will be sold as their property, subject to any outstanding ad valorem taxes, assessments, and liens or interests superior to the Security Deed first set out above. The undersigned will execute a deed to the purchaser at said sale as provided in said Security Deed.
