NOTICE OF SALE UNDER POWER
GEORGIA, COFFEE COUNTY
By virtue of the power of sale contained in the Deed to Secure Debt from New 2 U LLC and Addie M. Sullivan to Merchants & Citizens Bank, dated October 10, 2008, recorded in Deed Book 1437, pages 95-98, in the Office of the Clerk of Superior Court of Coffee County, Georgia, conveying the property described hereinafter to secure a Note in the original principal amount of $30,611.02, with interest thereon as set forth therein, for a total amount of $31,294.66 (as of July 22, 2012) being due, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Coffee County, Douglas, Georgia, during the legal hours of sale on the FIRST TUESDAY IN September, 2012, the following described property, to-wit:
Tract 1: All that certain tract or parcel of land situate lying and being in Original lots of land nos. 178 and 179 in the Sixth Land District of Coffee County, Georgia containing 3.614 acres, more or less, and being more particularly described as Tract 1 according to a plat prepared by Carlton Evans, Registered land surveyor, dated August 12, 1980, and recorded in the Office of the Clerk of Superior Court of Coffee County Georgia in Plat Book 26 at page 23 which plat is hereby referred to and made a part of this description.

All that tract or parcel of land lying and being in Original Lot of Land no 179 in the Sixth Land District of Coffee County, Georgia and containing 5-1/2 acres and more particularly described according to a plat prepared by Rufus C. Johnson Civil Engineer on September 9 1954, and recorded in Plat Book 2 page 334 in the office of the clerk of superior court of Coffee Co Ga, as follows: BEGINNING on the west boundary line of the right-of-way of US Hwy 441 at a point 394.5 feet north 2 degrees 30 minutes west from the point at which the south original land lot line of said lot no 179 intersects the said west boundary line of the right of way of said highway US 441, and from said point of beginning thence running south 87 degrees 30 minutes west a distance of 535.65 feet to the east boundary line of Douglas Broxton extension of Georgia and Florida Railroad Company right of way, thence north 2 degrees 30 minutes east along said right of way a distance of 468.6 feet, thence north 87 degrees 30 minutes east a distance of 498.5 feet to the west boundary line of the right of way of US Hwy. 441, thence south 2 degrees 30 minutes east a distance of 464.8 feet along said right of way to the point of beginning. Said property having located thereon a six room dwelling of frame construction.

Subject to existing easements for public roads and utilities now in use.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of non-payment of the indebtedness when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Deed to Secure Debt and by law, including attorney fees, notice of intent to collect attorney fee having been given.
Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is ADDIE M. SULLIVAN, or a tenant or tenants, and said property commonly has an address of 2113 BROXTON ROAD, DOUGLAS, GEORGIA 31533.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
