NOTICE OF SALE UNDER POWER
GEORGIA, ELBERT COUNTY
Under and by virtue of the Power of Sale contained in a Security Deed given by Ronald B. Grimes and Renee K. Grimes to Mortgage Electronic Registration Systems, Inc. as Nominee for Fieldstone Mortgage Company, dated October 26, 2005, recorded in Deed Book 403, Page 590, Elbert County, Georgia records, as last transferred to HSBC Bank USA, National Association, as Indenture Trustee of the Fieldstone Mortgage Investment Trust, Series 2005-3 by assignment recorded or to be recorded, Elbert County, Georgia records conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED SIXTY SIX THOUSAND & 00/100 DOLLARS ($166,000.00); with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Elbert County, Georgia, within the legal hours of sale on the first Tuesday in September, 2012 the following described property:
TRACT 1: All that tract or parcel of land, lying and being in the 197th G.M. District of Elbert County, Georgia, containing 12.51 acres, more or less, and being bounded now or formerly as follows: on the northeast by Wilbur Cornell; on the east by Pulliam Mill Road; on the south and west by Jerry Hewell, et al; and on the northwest by Roebuck and Ingram. This being two (2) tracts of land surveyed for Henry Gill by C.M. Rucker, Registered Surveyor, and which is better described in plat, dated January 28, 1980, and recorded in plat book 12, page 356, Elbert Superior Court Records, to which reference is made for a more complete and accurate description of the property conveyed hereby.
TRACT 2: All that tract or parcel of land, situate, lying and being in the 197th District G.M., Elbert County, Georgia, containing 2.27 acres, bounded on the northeast by Beaverdam Creek (the center of the creek being the line); on the southeast by right of way of Pulliam Mill (paved) road; on the southwest by property of W.W. Adams and property of Roebuck; and on the northwest by Beaverdam Creek (the center of the creek being the line), and being more particularly described by plat thereof prepared by Clelland A. Tyson, surveyor, dated June 3, 1975, and recorded in Plat Book 10, Page 11, and being part of a tract containing 8 3/4 acres described in deed thereof from Mrs. William R. Pulliam Sr. to James S. Canales, dated January 28, 1958, and recorded in Deed Book 62, Page 336, Elbert Superior Court Records, by reference made a part hereof.
This being the same property described in a warranty deed from Ronald W. Grimes and Michele Joan grimes to Ronald B. Grimes and Renee K. Grimes, dated January 12, 2005, recorded on January 13, 2005, in Deed Book 384 at Pages 216-217 in the Office of the Clerk of Superior Court of Elbert County, Georgia.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney fees (notice of intent to collect attorney fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Ocwen Loan Servicing LLC, Attention: Home Retention Department, 1661 Worthington Road, Suite 100, West Palm Beach, FL 33409, 877-596-8580. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.
To the best knowledge and belief of the undersigned, the parties in possession of the property are Ronald B. Grimes and Renee K. Grimes or a tenant or tenants and said property is more commonly known as 2103 Pulliam Mill Rd. NW, Dewy Rose, GA 30634.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
