Under and by virtue of the Power of Sale contained in a Security Deed given by Jonathan Herrmann and Jennifer Mitchell to Mortgage Electronic Registration Systems, Inc as nominee for SunTrust Mortgage, Inc, dated March 26, 2009, recorded in Deed Book 691, Page 277, Grady County, Georgia Records, as last transferred to SunTrust Mortgage, Inc by assignment recorded in Deed Book 749, Page 702, Grady County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of EIGHTY-SIX THOUSAND FOUR HUNDRED SIX AND 0/100 DOLLARS ($86,406.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Grady County, Georgia within the legal hours of sale on the first Tuesday in February, 2013, the following described property:All that tract or parcel of land situate, lying and being in Land Lot No. 88 of the 18th Land District, Grady County, Georgia, and being more particularly identified on a plat of survey prepared for Bobby J. Phillips by Richard G. Matthews, Georgia Registered Land Surveyor No. 2217, dated August 27, 2002, and recorded in Plat Book 38, Page 98 among the Deed Records of Grady County, Georgia, which said plat made a part hereof for a more particular description of the subject property by metes and bounds and courses and distances as set forth thereon. Less and Except that certain 0.193 acre parcel, more or less, as right of way for Moore Road taken by condemnation by the Grady County Board of Commissioners in Civil Action File No. 02-v-377, and recorded in Deed Book 550, Page 671 among the Deed Records of Grady County, Geogia.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney fees (notice of intent to collect attorney fees having been given). Suntrust Mortgage, Inc. holds the Note and Security Deed to the above-referenced property and services the above-referenced loan on behalf of the current owner of the loan: SunTrust Mortgage, Inc. Suntrust Mortgage, Inc. can be contacted at 866-384-0903 or by writing to 1001 Semmes Avenue, Richmond, VA 23224, to discuss possible alternatives to foreclosure, and has the authority to negotiate, amend or modify the terms of the loan. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Jonathan Herrmann and Jennifer Mitchell or a tenant or tenants and said property is more commonly known as 898 Moore Road, Cairo, Georgia 39828. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
