NOTICE OF SALE UNDER POWER GEORGIA, HENRY COUNTY Because of default in the payment of the indebtedness, secured by a Security Deed executed by June Pitney and Paul M. Pitney to Beneficial Mortgage Co. of Georgia dated July 25, 2002 in the amount of $194,068.48, and recorded in Deed Book 5172, Page 24, Henry County, Georgia Records; as last transferred to Beneficial Financial I Inc. by assignment; the undersigned, Beneficial Financial I Inc. pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, and pursuant to O.C.G.A. Franks, Registered Land Surveyor, dated 6/17/87, of record in Plat book 14,Page 248, Henry County Records, as follows: Beginning at an iron pin located on the South R/W line of Cotton Indian Road (50 ft. R/W) at a point which is located 3002.3 feet Easterly as measured along the Southerly R/W line of Cotton Indian Road from its intersection with the West line of Land Lot 40 (said point also being 2400.0 feet Easterly as measured along the Southerly R/W line of Cotton Indian Road from the West line of W.M. Cook Property), and running thence North 88 degrees 28 minutes East along the Southerly R/W line of Cotton Indian Road 225.0 feet to an iron pin; thence South 00 degree 55 minutes West 528.3 feet to an iron pin and continuing in the same direction 29.7 feet, more or less, to the center of little Cotton Indian Creek; thence Southwesterly along centerline of Little Cotton Indian Creek 140 feet, more or less, to a point; thence North 8 Degrees 15 minutes West 33.9 feet, more or less, to an iron pin (at a point which is South 88 degrees 10 minutes West 140.8 feet from the last above-mentioned iron pin); thence North 8 degrees 15 minutes West 532.3 feet to the Point of Beginning. Tax map or parcel id No.: 117-03035000 which has the property address of 420 Cotton Indian Creek Road (aka Cotton Indian Road), McDonough, Georgia., together with all fixtures and other personal property conveyed by said deed. The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
