Under and by virtue of the Power of Sale contained in a Security Deed given by James A. Griffin, Jr. and Vicky Griffin to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR FIRST NLC FINANCIAL SERVICES, LLC, dated July 26, 2007, recorded in Deed Book 773, Page 380, Jones County, Georgia records and Deed Book 318, Page 4, Wilkinson County, Georgia records, as last transferred to MTG FINANCE, LLC by assignment recorded or to be recorded, Jones; Wilkinson County, Georgia records conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED SIXTY EIGHT THOUSAND AND N0/100 DOLLARS ($168,000.00); with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Jones County, Georgia, within the legal hours of sale on the first Tuesday in December, 2012 the following described property:
THE FOLLOWING DESCRIBED REAL PROPERTY SITUATE IN THE CITY OF GORDON, COUNTY OF WILKINSON, AND STATE OF GEORGIA. TO WIT:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOTS 118 AND 119 OF THE 6TH LAND DISTRICT OF JONES AND WILKINSON COUNTIES. GEORGIA, CONTAINING 5.05 ACRES AND BEING KNOWN AND DESIGNATED AS TRACT NO. 1-B ACCORDING TO A PLAT THEREOF ENTITLED SUBDIVISION SURVEY FOR JAMES GRIFFIN MADE BY JOHN W. WILKES, REGISTERED LAND SURVEYOR, DATED MARCH 9, 2000. A COPY OF WHICH PLAT IS RECORDED IN PLAT BOOK 18, PAGE 216 IN THE CLERKS OFFICE OF WILKINSON SUPERIOR COURT AND PLAT BOOK 16, PAGE 44, IN THE CLERK S OFFICE OF JONES SUPERIOR COURT. SAID PLATS ARE INCORPORATED HEREIN AND MADE PART HEREOF BY REFERENCE THERETO FOR PURPOSES OF SHOWING THE METES, BOUNDS AND DIMENSIONS OF THE PROPERTY HEREIN CONVEYED.
SAID PROPERTY IS A PORTION OF THE PROPERTY CONVEYED TO THE GRANTORS HEREIN BY DEED DATED JUNE 17, 1994 FROM SOUTHERN PINE PLANTATIONS, INC. AND SHEPARD BROTHERS TIMBER COMPANY, INC.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.
To the best knowledge and belief of the undersigned, the parties in possession of the property are James A. Griffin, Jr. and Vicky Griffinor a tenant or tenants and said property is more commonly known as 810 Nitrogen Road, Gordon, GA 31031.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
