UNDER POWER

GEORGIA, MARION COUNTY

Under and by virtue of the Power of Sale contained in Security Deeds given by THOMAS BENTLEY AND ASHLEY LANE BENTLEY to WILLIAM WERTZ dated April 15, 2011, recorded in Deed Book 198, Pages 392-395, and dated November 16, 2011, recorded in Deed Book 201, Pages 157-159, MARION County, Georgia Records, conveying the after-described property to secure Notes in the original principal amount of SIXTY EIGHT THOUSAND FIVE HUNDRED AND NO/100 ($68,500.00) DOLLARS, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of MARION County, Georgia, within the legal hours of sale on the first Tuesday in SEPTEMBER, 2012, the following described property:

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney fees (notice of intent to collect attorneys fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is THOMAS BENTLEY AND ASHLEY LANE BENTLEY or a tenant or tenants and said property.

The description of said 19.690 acres and designated as Tract 4 on said plat is hereby by reference made a part hereof.

Subject to the building set back line as shown on said plat as well as the 262.50 feet power line easements all as shown on said plat of survey.

Also a permanent, perpetual, non-exclusive 30 feet wide access easement shown on said plat and leading from Harbuck Pond Road westerly along the top of the property owned by Conerly, the north edge of Tract 2, the northern edge of property marked Wertz between Tract 2 and Tract 3, and along the northerly and westerly side of Tract 3, all as shown on said plat referred to hereinabove.

TRACT 2: All that tract or parcel of land lying and being in Land Lot 153 of the 4th Land District of Marion County, Georgia, consisting of Tract 4-B containing 0.149 acres as shown on a plat of survey prepared by Paul H. Johnson, Jr., Georgia Registered Surveyor No. 2091, dated November 14, 2011, and recorded in Plat Book L, Page 225, Marion County, Georgia, Records, which is by reference made a part hereof. The description of said Tract 4-B consisting of 0.149 acres on said plat is hereby by reference made a part hereof.

Said properties are subject to all easements, rights of way and restrictions on record.

LESS AND EXCEPT: All that tract or parcel of land lying and being in Land Lot 153 and 154 of the 4th Land District of Marion County, Georgia, consisting of Tract 4-A containing 0.149 acres as shown on a plat of survey prepared by Paul H. Johnson, Jr., Georgia Registered Surveyor No. 2091, dated November 14, 2011, and recorded in Plat Book L, Page 225, Marion County, Georgia, Records, which is by reference made a part hereof. The description of said Tract 4-A consisting of 0.149 acres on said plat is hereby by reference made a part hereof.
