UNDER POWER

GEORGIA, MARION COUNTY

Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by Joseph Halstead and Kasie Halstead to Walter Mortgage Company, subsequently d/b/a Walter Mortgage Company, LLC, dated November 19, 2010 and recorded on December 27, 2010, in Deed Book 196, Page 624, in the Office of the Clerk of Superior Court for Marion County, Georgia, conveying the after described property to secure a Note for the original indebtedness, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Marion County, Georgia, within the legal hours of sale on the first Tuesday in September, 2012 the following described property:

All that tract or parcel of land lying and being in Land Lot 40 of the 4th Land District of Marion County, Georgia, containing 1.29 acres and more particularly described as follows: to arrive at the point of beginning, start at a point where the South R.O.W. margin of the Brantley Road intersects in the East R.O.W. of the Johnny Miller Road, thence South a distance of 256.26 feet to a point, thence North 80 degrees 57 minutes 04 seconds East a distance of 446.38 feet to the point of beginning. Thence North a Distance of 126.26 feet to a point, thence North 78 degrees 17 minutes 47 seconds East a Distance of 70 feet, thence North a distance of 70 feet to a point, thence North 78 degrees17 minutes 47 seconds East a distance of 209.64 feet to a point, thence South 11 degrees 34 minutes 03 seconds East 210 feet to a point, thence South 81 degrees 29 minutes 37 seconds West a distance of 319.46 feet to the point of beginning, containing 1.29 acres according to a plat of survey by Hugh Riley and Associates, dated February 14, 1996 and recorded in Plat Book G, Page 8, Marion County, Georgia records, which is by reference made a part hereof. Also, a perpetual easement for ingress and egress to and from said property to the nearest roadway.

Also, that easement to and from said property as described above: commence at the point of beginning of above described 1.29 acre tract, thence North 166.26 feet to the point of beginning of said Easement, thence South 78 degrees 17 minutes 47 seconds West 56 feet, thence North 19 degrees 53 minutes West 213 feet to the South margin of Brantley Road, thence North 72 degrees 40 minutes East 30 feet, thence South 19 degrees 53 minutes East 185.8 feet, thence North 78 degrees 17 minutes 47 seconds East 100 feet, thence South 30 feet, thence South 78 degrees 17 minutes 47 seconds West 70 feet, more or less, to the Point of Beginning.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney fees, notice of intent to collect attorney fees having been given.

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure. Debt first set out above, the same having been assigned by Walter Mortgage Company, n/d/b/a Walter Mortgage Company, LLC, further assigned to William J. Wade as trustee of Mid-State Trust VII, further assigned to First Union National Bank of North Carolina and successor by merger to First Union National Bank of Florida, a National Banking Association, as Trustee, succeeded by merger to U.S. Bank, N.A., as trustee on behalf of Mid-State Trust VII, by Green Tree Servicing LLC, as servicer with delegated authority.

To the best of our knowledge and belief of the undersigned, the parties in possession of the property is Joseph and Kasie Halstead and/or tenants and said property is more commonly known as 1621 Brantley Road, Buena Vista, Georgia 31803-3314.
