NOTICE OF SALE UNDER POWER
GEORGIA, MCINTOSH COUNTY
By virtue of the power of sale contained in a Security Deed from Carolyn Thomas and Gregory Thomas to Mortgage Electronic Registration Systems Inc., as nominee for First Bank Mortgage a division of First Bank of Georgia, its successors and assigns dated December 17, 2007 recorded in Deed Book 490, Page 19 re-recorded at Deed Book 496, Page 75 recorded March 31, 2008, McIntosh County Records, and last assigned to JPMorgan Chase Bank, National Association, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED SIXTY-THREE THOUSAND NINE HUNDRED TWENTY-SEVEN AND 00/100 ($163,927.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of McIntosh County, Georgia, during the legal hours of sale on the first Tuesday, February 5, 2013 the following described property, to wit:
All of that certain lot, tract or parcel of land situate, lying and being in part in the corporate limits of the City of Darien, 1771st GMD, and 271st GMD, McIntosh County, Georgia, being more particularly described as ALL OF LOT 11, KELLS LANDING SUBDIVISION, and being shown on that plat of survey prepared by Charles W. Johnson, Jr., Georgia RLS No. 2698, under date of March 13, 2002 and recorded in Plat Cabinet 1, Slide 175-K, Office of the Clerk, McIntosh County Superior Court. Reference is hereby made to said plat for further purposes of description.
Said property being the same property conveyed by deed dated April 3, 2003 from Trudy Enterprises, Inc. to Anthony W. Branch and MaryBeth D. Branch as recorded in the Office of the Clerk of Superior Court, McIntosh County, Georgia in Deed Book 334, Page 297.
The Debt secured by said Security Deed has been and is hereby declared due because of nonpayment of the indebtedness when due and in the manner provided in the Note and Security Deed. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorney s fees, notice of intent to collect attorney s fees having been given.
Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is Carolyn Thomas and Gregory Thomas or, a tenant or tenants, and said property was or is commonly known as 1101 Kelsey s Way, Darien, GA 31305.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
