THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Under and by virtue of the Power of Sale contained in a Security Deed given by John C Black and Amy H Black to Mortgage Electronic Registration Systems, Inc., dated August 20, 2008, recorded in Deed Book 254, Page 642, Pulaski County, Georgia Records, as last transferred to SunTrust Mortgage, Inc. by assignment recorded in Deed Book 278, Page 508, Pulaski County, Georgia Records,conveying the after-described property to secure a Note in the original principal amount of TWO HUNDRED FORTY-THREE THOUSAND SIX HUNDRED SEVENTY-EIGHT AND 0/100 DOLLARS ($243,678.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Pulaski County, Georgia within the legal hours of sale on the first Tuesday in December, 2012, the following described property:

All that tract or parcel of land situate, lying and being in Land Lot 225 in the 12th Land District of Pulaski County, Georgia, and in the City of Hawkinsville, containing 0.57 acres, lying on the easterly margin of Camden Way (fronting 136.55 feet thereon). Said tract is further known and identified as Lot 14 of Block "B" of Phase One of Southern Hills Plantation, LLC and is more particularly described according to plat of survey of said subdivision prepared by James Edward Flanders, Surveyor, on August 19, 1997, and revised on October 20, 1997, which plat, of record in Plat Book 11, page 160, Clerk's Office, Pulaski Superior Court, is incorporated herein in aid of this description and for all legal purposes. Refer to said plat for the metes, bounds, courses and distances of said lot.

Also granted hereby is a permanent, but non-exclusive, easement for purposes of ingress and egress to the subject property from Georgia Highway No. 247 (Hawkinsville-Warner Robins Highway) over, across and through Plantation Drive from its intersection with said Georgia Highway No. 247 and to Camden Way and along said Camden Way to the subject property, said Plantation Drive and Camden Way being depicted on plats of said Phase One, both dated August 19, 1997, and revised October 20, 1997, and October 21, 1997, and of record, respectively, in Plat Book 11, page 160 and page 161, Clerk's Office, Pulaski Superior Court, to which reference is hereby specifically made in aid of the description of such easement. A specific condition of this easement is that upon its dedication to, and acceptance by, the City of Hawkinsville, as a public street(s), this easement shall be automatically terminated and extinguished

Subject to that certain "Declaration of Protective Covenants for Phase One of Southern Hills Plantation, LLC" dated and filed September 29, 1997, of record in Deed Book 164, at pages 109-127, Clerk's Office, Pulaski Superior Court. Also subject lot that certain "First Amendment to Declaration of Protective Covenants for Phase One of Southern Hills Planation, LLC" dated October 31, 1997, filed November 5, 1997, of record in Deed Book 164, at page 620, Clerk's Office, Pulaski Superior Court, and to that certain "Second Amendment to Declaration of Protective Covenants for Phase One of Southern Hills Plantation, LLC" dated November 20, 1997, filed November 21, 1997, of record in Deed Book 165, at page 22, Clerk's Office, Pulaski Superior Court.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney fees (notice of intent to collect attorney fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

SunTrust Mortgage, Inc. is the holder of the Note and Security Deed to the property in accordance with OCGA 44-14-162.2.

The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Suntrust Mortgage, Inc., 1001 Semmes Avenue, Richmond, VA 23224, 866-384-0903.

To the best knowledge and belief of the undersigned, the party in possession of the property is John Cameron Black and Amy Hodge Black or a tenant or tenants and said property is more commonly known as 75 Camden Way, Hawkinsville, Georgia 31036.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.

This law firm is seeking solely to foreclose the creditor lien on real estate and this law firm will not be seeking a personal money judgment against you.
