THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Under and by virtue of the Power of Sale contained in a Security Deed given by David A. East to Wells Fargo Bank, N. A, dated February 27, 2008, recorded in Deed Book 630, Page 557, Putnam County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of FOUR HUNDRED SEVENTEEN THOUSAND AND 0/100 DOLLARS ($417,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Putnam County, Georgia within the legal hours of sale on the first Tuesday in December, 2009, the following described property: SEE EXHIBIT A ATTACHED HERETO AND MADE A PART HEREOF

EXHIBIT A

All that certain unit and being in Land Lot 328 of the 3rd Land District, 389th G.M.D. of Putnam County, Georgia, described as Unit 301, Building 3, of Town Homes of Phoenix Shores, having such shape, courses, metes and distances as will more fully appear on that survey prepared by John A. McGill, Jr., RLS 2858, filed and recorded in Plat Cabinet 1, Plat Book 31, Slide 31, Pages 259-260, in the office of the Clerk of the Superior Court of Putnam County , Georgia, said plat and the record thereof are incorporated herein and made a part hereof by reference.

Also conveyed herewith is an easement for ingress and egress to said Building 1, 2 and 3 for vehicular traffic as detailed on the aforementioned survey labeled as " Asphalt Parking Area".

Also conveyed herewith is an easement for recreational, pedestrian for use and enjoyment by owners of Units 101-105, Units 201-205 and Units 301-305, on the designated "Common Area" described by the Covenants governing subject property and that aforementioned survey.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Wells Fargo Home Mortgage, Inc., PO Box 10335, Des Moines, IA 50306, 1-800-416-1472. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.

To the best knowledge and belief of the undersigned, the party in possession of the property is David A. East or a tenant or tenants and said property is more commonly known as 549 Phoenix Dr # 301, Unit 301, Eatonton, Georgia 31024.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
