NOTICE OF SALE UNDER POWER
GEORGIA, TERRELL COUNTY
Because of default in the payment of the indebtedness, secured by a Security Deed executed by Dennis Jones, Sr. to Mortgage Electronic Registration Systems, Inc. as nominee for Aegis Lending Corporation, its successors and assigns dated January 10, 2007 in the amount of $56,000.00, and recorded in Deed Book 8-K, Page 69, Terrell County, Georgia Records; as last transferred to U.S. Bank National Association, as Trustee, successor in interest to Bank of America, National Association as Trustee as successor by merger to LaSalle Bank National Association, as Trustee for Certificateholders of Bear Stearns Asset Backed Securities I LLC, Asset-Backed Certificates, Series 2007-HE5 by assignment; the undersigned, U.S. Bank National Association, as Trustee, successor in interest to Bank of America, National Association as Trustee as successor by merger to LaSalle Bank National Association, as Trustee for Certificateholders of Bear Stearns Asset Backed Securities I LLC, Asset-Backed Certificates, Series 2007-HE5 pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in September, 2012, during the legal hours of sale, at the Courthouse door in Terrell County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:
All that tract or parcel of land lying and being in the City of Dawson, Terrell County, Georgia, and being the North 16 feet 8 inches of Lot No. Eleven (11), all of Lot No. Twelve (12), and the South 16 feet 8 inches of Lot No. Thirteen (13) of the Joseph H. Phillips Fair-Ground addition to the City of Dawson according to a plat of said addition as recorded in Deed Book S, Page 481, in the Office of the Clerk of Superior Court of Terrell County, Georgia. The herein described property is more particularly defined and delineated by reference to a survey and plat of the same made by Richard M. Pace, Surveyor, under date of May 14, 1973, which is recorded in the Office of the Clerk of Superior Court of Terrell County, Georgia, in Plat Book 4, Page 68, which plat, survey and the record thereof are by express reference hereto incorporated herein and made a part of this description. which has the property address of 252 Wheeler Street SW, Dawson, Georgia, together with all fixtures and other personal property conveyed by said deed.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed.
Said property will be sold as the property of Dennis Jones, Sr. and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
