GEORGIA, TURNER COUNTY
Under and by virtue of the Power of Sale contained in a Security Deed given by Gerald W. Hudgins to The First National Bank of Barnesville recorded in Deed Book 219, Page 37 et. seq. Turner County, Georgia Records and as transferred and assigned to United Bank from Federal Deposit Insurance Corporation, as Receiver of The First National Bank of Barnesville, as more properly reflected in the Assignment of Promissory Note and Security Deed recorded in Deed Book 237, Page 823, et. seq., Turner County, Georgia Records, said Security Deed being to secure a Promissory Note in the original principal amount of Eight Hundred Eighty-Nine Thousand Eight Hundred Fifty and 00/100 Dollars ($889,850.00) there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Turner County, Georgia within the legal hours of sale on the first Tuesday in December, 2012, the following described property:
TRACT TWO: All that tract or parcel of land aggregating 165.45 acres in Land Lot Number Two Hundred Thirty-Five (235) and Two Hundred Thirty-Six (236) of the Second (2nd) Land District of Turner County, Georgia, consisting of Tracts A, B and C on that certain plat of survey dated November 24, 1992, prepared by Jerry J. Lee, Registered Surveyor, for Jim Lumpkin, and is recorded in plat Cabinet B-13, in the Office of the Clerk of the Superior Court of Turner County, Georgia,
LESS AND EXCEPT: All that tract or parcel of land lying in Land Lot 235 of the 2nd Land District, Turner County, Georgia, containing 4.00 acres, more or less, and being more particularly described as follows: Beginning at an iron pin located on the westerly right of way line of State Route No. 159 North 28 degrees 26 minutes 53 seconds East a distance of 851.5 feet from the intersection of the westerly right of way line of State Route No. 107 with the center line of Jackson Road; thence run North 47 degrees 43 minutes 25 seconds West for a distance of 775.18 feet to a point and corner located at a fence line; thence run North 89 degrees 03 minutes 34 seconds East along a fence line 442 feet to a point and corner; thence run South 47 degrees 28 minutes 29 seconds East for a distance of 379.98 feet to a point and corner located on the westerly right of way line of State Route No. 159; thence run South 28 degrees 26 minutes 53 seconds West along the westerly right of way line of State Route No. 159 for a distance of 310.00 feet to the point of beginning.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney fees (notice of intent to collect attorney fees having been given). Said property will also be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is Gerald W. Hudgins or tenants. The individual who shall have full authority to negotiate, amend and modify all terms of the mortgage with the debtor is Kathy Pippin, United Bank, P.O. Box 340, Barnesville, GA 30204, (770) 412-4941. Nothing in O.C.G.A. 44-14-162.2 shall be construed to require this lender to negotiate, amend or modify the terms of the mortgage.
