GEORGIA, TURNER COUNTY

THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Under and by virtue of the Power of Sale contained in a Security Deed given by CHARLES A. VAUGHN, III to COLONY BANK WILCOX dated August 21, 2006, recorded in Deed Book 208, Pages 332-339,Turner County, Georgia Records, conveying the after-described property to secure a Note in the amount of Thirty-Five Thousand Five Hundred Forty-Seven Dollars and 00/100 ($35,547.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Turner County, Georgia, within the legal hours of sale on the first Tuesday in December, 2012, the following described property:

All that tract or parcel of land lying and being in Land Lot 231 in the 2nd Land District of Turner County, GA, containing 4.59 acres, more or less, and being more particularly described as follows: Begin at an iron pin located in the center of Hicks Road South 33 degrees 15 minutes West a distance of 1,259.1 feet from the intersection of the center line of Hicks Road with the center line of Amboy-Rebecca Road; thence run South 41 degrees 05 minutes 24 seconds West along the center line of Hicks Road for a distance of 223.69 feet to a point and corner; thence run South 44 degrees 43 minutes 12 seconds West along the center line of Hicks Road for a distance of 309.78 feet to a point and corner; thence run North 67 degrees 10 minutes 44 seconds West for a distance of 225.67 feet to a point and corner; thence run North 23 degrees 15 minutes 15 seconds West for a distance of 220.74 feet to a point and corner; thence run North 64 degrees 24 minutes 22 seconds East for a distance of 713.41 feet to a point and corner; thence run South 04 degrees 33 minutes 41 seconds East for a distance of 210.48 feet to the Point of Beginning. All according to that certain plat of survey prepared for A.L. Hobby by Jerry J. Lee, Registered Land Surveyor, dated February 28, 1997, and recorded in Plat Slide B-34 in the office of the Clerk of Superior Court of Turner County, GA, said plat of survey being incorporated herein by reference for descriptive purposes. Being the same property conveyed from A.L. Hobby to Cathryn W. Thomas by Warranty Deed dated March 6, 1997, and recorded in Deed Book 148, Page 206 in the office of the Clerk of the Superior Court of Turner County, Georgia.

Also conveyed is a 2001 General Product Mobile Home, Vehicle ID Number GMHGA4440027712.

Subject to existing easements and conveyances for roadways and public utilities serving said property.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in said Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is CHARLES A. VAUGHN, III or a tenant or tenants.

Pursuant to O. C. G. A. 44-14-162.2, the name, address and telephone number of the individual or entity who shall have the full authority to negotiate, amend, or modify all terms of the above described mortgage is as follows: COLONY BANK, 115 S. GRANT STREET, FITZGERALD, GA 31750. Telephone: 229-426-6095. The foregoing notwithstanding, nothing in O. C. G. A. 44-14-162.2 shall be construed to require COLONY BANK to negotiate, amend or modify the terms of the Deed to Secure Debt described herein.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
