NOTICE OF SALE UNDER POWER
GEORGIA, WAYNE COUNTY
By virtue of the power of sale contained in a Security Deed from Stephen M. Dear, Sr. to Mortgage Electronic Registration Systems Inc., as nominee for Prime South Mortgage dated February 21, 2008 recorded in Deed Book 34K, Page 21-30 , Wayne County Records, and last assigned to JPMorgan Chase Bank, National Association, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED THIRTY-SEVEN THOUSAND TWENTY-FIVE AND 00/100 ($137,025.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Wayne County, Georgia, during the legal hours of sale on the first Tuesday, December 4, 2012 the following described property, to wit:
All of that certain tract or parcel of land situate, lying and being in the City of Jesup, Wayne County, Georgia, being known and designated as Lot Number 10, Block "C", of Wayne Terrace Subdivision, and being shown and delineated on a certain plat of same prepared by Quillie E. Kinard, Jr., G.R.L.S. Number 1572, dated August 24, 1989, and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia, in Plat Book 22, page 167, and being bounded as follows: on the Northeast for a distance of 155 feet by Charlton Street; on the Southeast for a distance of 170.7 feet by Lot 11, Block "C" of said subdivision; on the Southwest for a distance of 155 feet by a certain 20-foot lane; and on the Northwest for a distance of 170.7 feet by Land 9, Block "B" of said subdivision; on the Southwest for a distance of 155 feet by a certain 20-foot lane; and on the Northwest for a distance of 170.7 feet by Lot 9, Block "B" of said subdivision. For a further description of said property reference is made to the aforesaid plat and the record thereof.
This being the same property conveyed from Vivian Dunham to Stephen M. Dear; by deed, dated February 19, 1993, and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia, in Deed Book 313, Page 15.
Provided however, said property subject to that certain declaration of restrictions, conditions, etc., dated February 19, 1968, and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia, in Deed Book 119, page 129, and also subject to a ten-foot drainage easement which is reserved unto Norris B. Strickland to Sidney S. Haskins and Hazel H. Haskins, dated February 19, 1971.
The Debt secured by said Security Deed has been and is hereby declared due because of nonpayment of the indebtedness when due and in the manner provided in the Note and Security Deed. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorney's fees, notice of intent to collect attorney's fees having been given.
Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property Stephen M. Dear, Sr. or, a tenant or tenants, and said property was or is commonly known as 119 Charlton Street, Jesup, GA 31545.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
