NOTICE OF SALE UNDER POWER
GEORGIA, WAYNE COUNTY
Because of default in the payment of the indebtedness, secured by a Security Deed executed by Jonathan Albert to Mortgage Electronic Registration Systems, Inc. as nominee for Taylor, Bean & Whitaker Mortgage Corp., its successors and assigns dated November 9, 2007 in the amount of $52,164.00, and recorded in Deed Book 34B, Page 410, Wayne County, Georgia Records; as last transferred to Cenlar FSB by assignment; the undersigned, Cenlar FSB pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in December, 2012 , during the legal hours of sale, at the Courthouse door in Wayne County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:
All of that certain tract or parcel of land situate, lying and being in Land Lot 79, of the Third Land District, of Wayne County, Georgia, and being designated as Lot 2, Phase 2, Ridge Subdivision, according to that certain plat, prepared by Quillie E. Kinard, Jr., G.R.L.S. No. 1572, dated July 10, 1996, and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia, in Plat Book 33, Page 159. Said plat and the record thereof is incorporated herein by reference for all purposes of description. This being the same property conveyed to Robert M. Brown, Sr. and Taphenia D. Brown, by Warranty Deed with rights of survivorship, dated April 28, 2005, recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia, in Deed Book 474, Page 184. The said Robert M. Brown, Sr., having died on April 23, 2007, and a copy of his death certifcate is on file in the Office of the Probate Court, Wayne County, Georgia. Subject to those certain restrictive covenants, applicable to The Ridge Subdivision, dated May 1, 1983, recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia, in Deed Book 223, Page 301. Together with that certain 1997 General Product Mobile Home, Model No. 5624, VIN Nos. GMHGA3309612378A and GMHGA3309612378B.
which has the property address of 192 Black Jack Rd, Jesup, Georgia., together with all fixtures and other personal property conveyed by said deed.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed. Notice has been also given, in writing and by certified mail, return receipt requested, to the borrower, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a).
Said property will be sold as the property of Jonathan Albert and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
