NOTICE OF SALE UNDER POWER
GEORGIA, WAYNE COUNTY
Because of a default in the payment of the indebtedness secured by that certain Security Deed executed by Donald S. Flood and Annette Flood to The Heritage Bank, dated the 10th day of July 2007, and recorded in the Clerk of Superior Court's Office, Wayne County, Georgia, in Mortgage Book 33-R, Page 404, as amended by Amendment to Loan Deed dated April 7, 2009 and recorded in the Clerk of Superior Court's Office, Wayne County, Georgia Mortgage Book 35-I, Page 600 the undersigned, The Heritage Bank, pursuant to the terms of said Deed to Secure Debt and Note secured, has declared the entire amount of the indebtedness thereby secured due and payable and pursuant to the power of sale contained in said Deed to Secure Debt, will, on the first Tuesday in December, 2012 during the legal hours of sale, at the Courthouse door in Wayne County, Georgia sell at public outcry to the highest bidder for cash, the real property described in said Security Deed, to wit:
All of that certain lot, tract or parcel of land, situate, lying and being in Land Lot 199 in the Third Land District of Wayne County, Georgia, containing 3.00 acres, more or less, and being more particularly shown on that certain plat prepared by Merlin J. Tomberlin, Georgia R.L.S. No. 2477, dated September 4, 2003 and recorded in the Office of the Clerk of Wayne County Superior Court in Plat Book 42, Page 98. Reference is hereby made to said plat and the record thereof for all purposes.
Along with a 1998 General Mobile Home, VIN Number LHSC544971271, attached thereto and made a part hereof.
Said property will be sold as the property of Donald S. Flood and Annette Flood, or their lawful grantee or assigns, and the proceeds of said sale will be applied to the payment of said indebtedness; costs of said sale, including attorney's fees, payment of governmental priority liens, if any, and the surplus, if any to Donald S. Flood and Annette Flood, their lawful grantee or assigns, if any, in title, all as provided in said Deed to Secure Debt and the undersigned will execute a deed to the purchaser at said sale as provided in the aforementioned Deed to Secure Debt. Said property will be sold subject to unpaid ad valorem taxes and easements, if any, recorded or unrecorded.
