NOTICE OF SALE UNDER POWER
GEORGIA, WAYNE COUNTY
Because of a default in the payment of the indebtedness secured by that certain Security Deed executed by Tommy Brantley to The Heritage Bank, dated the 14th day of January 2004, and recorded in the Clerk of Superior Court's Office, Wayne County, Georgia, in Mortgage Book 28-V, Page 341, last amended by Amendment to Loan Deed dated June 29, 2004 and recorded in the Clerk of Superior Court's Office, Wayne County, Georgia Mortgage Book 31-L, Page 529 the undersigned, The Heritage Bank, pursuant to the terms of said Deed to Secure Debt and Note secured, has declared the entire amount of the indebtedness thereby secured due and payable and pursuant to the power of sale contained in said Deed to Secure Debt, will, on the first Tuesday in March, 2013 during the legal hours of sale, at the Courthouse door in Wayne County, Georgia sell at public outcry to the highest bidder for cash, the real property described in said Security Deed, to wit:
All of that certain tract or parcel of land situate, lying and being in Land Lot 37 of the Third Land District of Wayne County, Georgia and being more particularly shown as Lot Number 88 on the revised plat of the Section One of the Fred Anderson Subdivision, which plat was prepared by Percy A. Brannen, Georgia Registered Land Surveyor, dated August 2, 1953 and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia in Deed Book 77, Page 166, which plat and the record thereof are by reference incorporated herein and made part of this description. Said tract being rectangular in shape and being bounded, now or formerly, as follows: on the North by Lot Number 89, said subdivision; on the East by Mahan Street; on the South by Douglas Way; and on the West by Lot Number 87 said subdivision.
This being the same property conveyed from James F. Wells and Carla R. Wells to Tommy J. Brantley by Warranty Deed dated March 30, 2000 and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia in Deed Book 401, Page 5.
SUBJECT TO that certain Right-of-Way Easement in favor of Satilla REMC, dated January 30, 2012 and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia in Deed Book 563, Page 99.
Said property will be sold as the property of Tommy Brantley, or his lawful grantee or assigns, and the proceeds of said sale will be applied to the payment of said indebtedness; costs of said sale, including attorney's fees, payment of governmental priority liens, if any, and the surplus, if any to Larry Brantley, his lawful grantee or assigns, if any, in title, all as provided in said Deed to Secure Debt and the undersigned will execute a deed to the purchaser at said sale as provided in the aforementioned Deed to Secure Debt. Said property will be sold subject to unpaid ad valorem taxes and easements, if any, recorded or unrecorded.
