NOTICE OF SALE UNDER POWER IN SECURITY DEED

Under and by virtue of the power of sale contained in the security deed from CHRIS H. GRAHAM to CITIZENS BANK & TRUST COMPANY, dated January 23, 2009, and recorded in Deed Book 15P, page 706, Telfair County Records, there will be sold by the undersigned at public outcry to the highest bidder before the Courthouse Door at Telfair County, Georgia, within the legal hours of sale, on the first Tuesday in December, 2012, the following described property:

All that tract or parcel of land lying and being in Land Lot No. 315 of the 9th Land District of Telfair County, Georgia, and being a 3.60 acre tract of land being more particularly described as follows: To find the POINT OF BEGINNING, START at the intersection of the Southeast land lot line of Land Lot No. 315 with the Southwest right of way line of Georgia Highway 117 and from said point run South 51 degrees 17 minutes 01 second West a distance of 169.92 feet to an iron pin, said pin being the POINT OF BEGINNING. From said POINT OF BEGINNING then run South 51 degrees 17 minutes 01 second West a distance of 588.35 feet to an iron pin; then run North 12 degrees 33 minutes 19 seconds West a distance of 315.12 feet to an iron pin; then North 49 degrees 11 minutes 42 seconds East a distance of 376.50 feet to an iron pin; then run North 76 degrees 56 minutes 06 seconds East a distance of 146.95 feet to an iron pin; then run South 24 degrees 26 minutes 00 seconds East a distance of 240.37 feet to an iron pin and the POINT OF BEGINNING. Said property being more particularly described according to a Plat of Survey prepared by William P. Johnson, Georgia Registered Land Surveyor No. 1713, dated April 15, 1997, and recorded in the Office of the Clerk of Telfair Superior Court in Plat Book 9, Page 74, said plat and the recording thereof being incorporated herein and made a part hereof by reference for descriptive and all other legal purposes.

Together with an easement 20 in width for ingress and egress to and from the above-described property leading to and from Ga. Highway 117 from Point A to Point B, which easement is more particularly described and delineated on the above-referenced Plat of Survey.

Subject to an ingress-egress easement 20 in width, extending across the above-described property from Point B to Point C as shown and delineated on the above-referenced Plat of Survey.

The debt secured by said security deed has been and is hereby declared due because of, among other possible events of default, failure to make payments in accordance with the terms of said note. The debt remaining in default, this sale will be made for the purpose of paying the same, and all expenses of sale, including attorney fees.

Said property will be sold subject to ad valorem taxes which are due or which are a lien; matters which might be disclosed by an accurate survey and inspection of the property; and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the security deed being foreclosed.
