NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF GLYNN By virtue of the power of sale contained in a Security Deed from Elizabeth C. Pickren to Mortgage Electronic Registration Systems, Inc., dated March 25, 2004, and recorded in Deed Book 1388, Page 7, and last transferred and assigned to Branch Banking and Trust Company ( B&T by assignment recorded in Deed Book 3025, Page 463 , Glynn County, Georgia records, there will be sold at public outcry for cash to the highest bidder before the courthouse doors of said county during the legal hours of sale on the first Tuesday in September, 2012, by BB&T, as Attorney-in-Fact for Elizabeth C. Pickren, the following described property, to-wit: All of that certain condominium unit constituting real property situate, lying and being on St. Simons Island, in Glynn County, Georgia, and being UNIT NUMBERED ONE (1), OF CEDAR WALK CONDOMINIUM (the nit , as shown on that certain Condominium Plat dated July 25, 1983, prepared by George P. Underwood, Jr., Georgia Registered Land Surveyor No. 1927, recorded in Plat Drawer 19, as Map No. 811, in the office of the Clerk of the Superior Court of Glynn County, Georgia. The Unit is part of the property described in Exhibit to the Declaration for Cedar Walk Condominium dated December 14, 1981 (the eclaration , recorded in Deed Book 22-X, Page 670, aforesaid records, as amended by Amendments to Declaration for Cedar Walk Condominium dated as follows: June 23, 1982, December 28, 1982, July 29, 1983, and October 12, 1983 (the mendments , all of which are respectively recorded in Deed Book 23-E, Page 811, Deed Book 23-O, Page 437, Deed Book 24-A, Page, 949, and Deed Book 24-F, Page 661, aforesaid records. The Unit includes an undivided interest in the common elements of Cedar Walk Condominium as set forth in the Declaration, and the Amendments thereto, together with all of the right, title and interest of Grantor in said Unit and the appurtenances, thereto under said Declaration, as amended. The above described Condominium Plat, the Declarations of Condominium, the Amendments thereto, and any other documents comprising a part of the condominium instruments, are incorporated herein by reference thereto and made a part hereof. Any reference to the Declaration made in this conveyance shall be deemed to include any recorded amendment thereto. This being the same real property conveyed by that certain warranty deed dated November 12, 2003, from Anthony Ferri to Elizabeth C. Pickren, recorded in Deed Book 1299, Page 315, aforesaid records. The indebtedness secured by said Security Deed having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney's fees, notice of intention to collect attorney's fees having been given as provided by law. The property will be sold as the property of Elizabeth C. Pickren or parties claiming under the aforementioned subject to the following: (1) all prior restrictive covenants, easements, right-of-ways, or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) all outstanding taxes, assessments, unpaid bills, charges and expenses that constitute liens against the property, whether due and payable or not yet due and payable, and matters of record superior to the Security Deed first set out above. To the best of the undersigned's knowledge and belief, the party in possession is Elizabeth C. Pickren, a tenant or tenants, or parties claiming under the aforementioned, and said property is more commonly known as 481 Cedar Walk, Saint Simons Island, GA 31522.
