NOTICE OF SALE UNDER POWER

COUNTY OF OCONEE
By virtue of the power of sale contained in a Security Deed from Steven LeGrand Fournier and Mary Dixon Fournier to Mortgage Electronic Registration Systems, Inc., dated May 27, 2004, and recorded in Deed Book 746, Page 276, and last transferred and assigned to Branch Banking and Trust Company ( B&T by assignment recorded in Deed Book 1148, Page 396, Oconee County, Georgia records, there will be sold at public outcry for cash to the highest bidder before the courthouse doors of said county during the legal hours of sale on the first Tuesday in February, 2013, by BB&T, as Attorney-in-Fact for Steven LeGrand Fournier and Mary Dixon Fournier, the following described property, to-wit:
ALL THAT TRACT OR PARCEL OF LAND situate, lying and being in the Dark Corner District, G.M., Oconee County, Georgia, being identified as Tract 2 containing 14.417 acres, more or less, as shown by that certain plat of survey entitled urvey for Claud Boyd Estate prepared by W.T. Dunahoo and Associates, Inc., certified by W.T. Dunahoo, Georgia Registered Surveyor No. 1577, dated January 28, 1985, revised as to Tract 1 on May 23, 1990 and revised as to Tract 3 on April 10, 1989, and being of record in the Office of the Clerk of the Superior Court for Oconee County, Georgia, in Plat Book 17, Page 150, which plat and its recording are by reference incorporated herein for further identification and description.
The indebtedness secured by said Security Deed having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney's fees, notice of intention to collect attorney's fees having been given as provided by law. BB&T Loss Mitigation Department is the name of the department at BB&T who has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor, and their address is: BB&T Loss Mitigation Department, 301 College Street, Greenville, South Carolina 29601; Phone # 800-827-3722, Option 6.
The property will be sold as the property of Steven LeGrand Fournier and Mary Dixon Fournier or parties claiming under the aforementioned subject to the following: (1) all prior restrictive covenants, easements, right-of-ways, or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) all outstanding taxes, assessments, unpaid bills, charges and expenses that constitute liens against the property, whether due and payable or not yet due and payable, and matters of record superior to the Security Deed first set out above.
To the best of the undersigned's knowledge and belief, the party in possession is Steven LeGrand Fournier and Mary Dixon Fournier, a tenant or tenants, or parties claiming under the aforementioned, and said property is more commonly known as 1311 Barber Creek Road, Statham, GA 30666.
