Under and by virtue of the Power of Sale contained in that certain Security Deed from WILLIAM ARNOLD PRICE AND NEZZIE F. PRICE to ATLANTIC COAST FEDERAL, dated April 21, 2004 and recorded in Deed Book 670, Page 320- 339, in the original principal sum of Seventy Two Thousand Dollars and 00/100 ($72,000.00), with interest from date at the rate stated in said Note on the unpaid bal- ance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Toombs County, Georgia, within the le- gal hours of sale on the first Tuesday in December, 2012, the property described on Exhibit A attached hereto and incorpo- rated herein by reference.
All that tract or parcel of land lying and being in the 1536th G.M. District, Toombs County, Georgia, containing 7.87 acres, and being bounded, now or formerly, as fol- lows: On the North by lands of Jeannie Meeks, lands of Ronnie & Susan Johnson and by lands of Isabel M. Ramirez; on the East by the right-of-way of Gibson Road a/ k/a County Road #262; on the South by lands of Mrs. Paul W. Tippett; and on the West by lands of Samuel A. Scott, Jr. Said property is more particularly described on a plat of survey prepared by R. Kim Dolan, Registered Land Surveyor, dated June 30, 2002, and recorded in Plat Book 28, Page 327, Clerk s Office Toombs Superior Court. Said plat is incorporated herein and made a part hereof by reference.
The Grantor/Borrower represents, cov- enants, and agrees that the 1998 Dynasty mobile home, Serial No. H811784GLR, lo- cated on the land is to remain on the land and has been permanently affixed to the land described herein, so as to become a part of the real property.
LESS AND EXCEPT: All that tract or parcel of land lying and being in the City of Vidalia, Toombs County, Georgia, in the 1536th G.M. District, containing 1.98 acres, more or less, and being more particularly shown as Parcel Number 2 and Parcel Number 3 according to a plat prepared by Dykes & Dolan Land Surveying, Survey- ors, from survey dated March 23, 2004 and recorded in Plat Book 31, Page 2, of the Toombs County Clerk s Office, which plat and the record thereof are by reference in- corporated herein and made a part of this description.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly in- stallments on said loan. The debt remain- ing in default, this sale will be made for the purpose of paying the same and all ex- penses of this sale, including attorney s fees (notice of intent to collect attorney s fees having been given).
The individual or entity that has full au- thority to negotiate, amend, and modify all terms of the security deed with the debtor is: Atlantic Coast Bank, 505 Haines Ave- nue, P.O. Box 1256, Waycross, GA 31501, 800-234-0642. Please understand that the secured creditor is not required to nego- tiate, amend, or modify the terms of the se- curity deed.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be dis- closed by an accurate survey and inspec- tion of the property, any assessments, li- ens, encumbrances, zoning ordinances, restrictions, covenants, and maters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is William Arnold Price and Nezzie F. Price or a tenant or tenants and said property is more commonly known as 493 GIBSON ROAD, LYONS, TOOMBS COUNTY, GEORGIA 30436.
The sale will be conducted subject (1) to confirmation that the sale is not prohibit- ed under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
