By virtue of the power of sale contained in that certain Deed to Secure Debt from JMC Holdings, Inc. to Mount Vernon Bank filed for record, and recorded in Deed Book 951, Pages 322-329, Toombs County, Georgia Records, said Deed to Secure Debt having been given to secure a Note dated December 2, 2010 and said note or the renewal thereof now being in default there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Lyons, Toombs County, Georgia, within the legal hours of sale on the first Tuesday in De- cember, 2012, the property described as:

Tract 1: All that tract or parcel of land, together with all improvements located thereon situate and lying and being in the City of Vidalia, in the 1823rd G.M. District of Toombs County, Georgia containing .953 acres and represented as Tract 1-A on that certain Aas built@ survey prepared for JMC Holdings, Inc., Mount Vernon Bank, Small Business Assistance Compa- ny and/or the United States Small Business Administration, and First American Title In- surance Company, said plat being pre- pared by Robert D. Smith, Jr. GRLS No. 2766, dated November 27, 2010, and re- corded in the Clerk=s Office of Toombs County, Georgia in Plat Book 31, page 210.

And also that certain 30-foot easement and 40-foot easement shown on Tract 1-B of the said plat for the benefit of Tract 1-A, and said easement as described and re- corded in Deed Book 533, pages 129-131.

And also, that certain 30 x 300 access and utility easement adjoining the east side of said Tract 1-A as shown on the above- described plat. Said easement is subject to those certain agreements for maintenance in the Warranty Deed recorded on De- cember 1, 2000 in Deed Book 545, pages 669-673 as corrected in Deed Book 547, pages 560-563, recorded in the Office of the Clerk of the Superior Court of Toombs County, Georgia.

The property shown as Tract 1-A is more commonly known as 2707 East First Street, Vidalia, Toombs County, Georgia, and has a current identification number of C27-038.

Tract 2: An easement for ingress, egress, maintenance, and installation of a sign on all that tract or parcel of land, lying and being in the City of Vidalia, in the 1823rd G.M. District of Toombs County, containing .007 acres of land and identified as Tract 2 on that certain Aas built@ sur- vey prepared for JMC Holdings, Inc., Mount Vernon Bank, Small Business As- sistance Company and/or the United States Small Business Administration, and First American Title Insurance Company, said plat being prepared by Robert D. Smith, Jr., GRLS No. 2766, dated Novem- ber 27, 2010, and recorded in the Clerk=s Office of Toombs County, Georgia in Plat Book 31, page 210. Grantor agrees that Grantee will at all times be able to maintain a sign and sign post of least the size and height of the sign existing on Tract 2 at the time of this conveyance. The approximate sign dimensions and height at the time of this conveyance are as follows: Sign Di- mensions: 13 L x 2 W. Sign Height is ap- proximately 20 .

Also included in regards to Tract 1 and Tract 2 are all permanent storm sewer easements and permanent sanitary sewer and power easements shown on the plat as referenced above.

The debt secured by said Deed to Se- cure Debt has been and is hereby declared due because of, among other possible events of default, non payment of the monthly installments and lack of insurance on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney s fees.

A copy of this legal advertisement (Notice of Sale Under Power) which was sent to The Advance has been mailed by certified mail, return receipt requested to JMC Holdings, Inc. if required by Georgia Law, O.C.G.A. 44 14 162.2 and 44 14 162.3.

Said property will be sold as the prop- erty of JMC Holdings, Inc. subject to any and all unpaid taxes, assessments, general subdivision restrictions, if any, and other restrictions and easements of record, if any; and to the best knowledge and belief of the undersigned, JMC Holdings, Inc. is in possession of said property.
