| 2~ / " A7 # 2 PAGE 651 WHEREAS, the United States of America now holds the above described security deeds covering the said real estate; WHEREAS, the Deeds to Secure Debt held by the united States of America provide that should default occur, the holder may declare the entire indebtedness secured by the Deeds to Secure Debt due and payable and, in compliance with the power of sale provisions contained in said security deeds proceed to sell the property at public outcry; and WHEREAS, after default, the United States of America has declared all of the indebtedness secured by the Deeds to Secure Debt due and payable and hereby certifies that it has complied with all of its loan servicing regulations. NOW, THEREFORE, the said United States of America, acting as aforesaid, under and in compliance with the power of sale provision contained in the Deeds to Secure Debt, will proceed to sell at public outcry, for cash or certifi ed funds to the highest bidder in front of the Courthouse in Baker County, during the legal hours of sale, on the 5th day of February, 2013, the following-described property conveyed in the Deeds to Secure Debt, to Wit: SEE ATTACHED EXHIBIT The above described property will be sold subject to any and all outstanding real estate taxes that are due and payable. The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the United States of America, be cause for rejection of the bid, and, if the bid is rejected, the United States of America shall have the option of making the sale to the next highest bidder who is ready, willing and able to comply with the terms thereof. The proceeds of said sale will first be applied to the payment of the indebtedness to the United States of America, other charges, and the expenses of sale, as provided in the above-described Deeds to Secure Debt. UNITED STATES OF AMERICA By Hobby Stripling, Hobby Stripling, SED Farm Service Agency U.S. Department of Agriculture Exhibit That certain tract or parcel of land situate, lying and being a part of Land Lot No. 39 in the 7th Land District of Baker County, Georgia, more particularly described as: Begin at an iron pin found at the original southwest corner of Land Lot No. 39 in the 7th Land District of Baker County, Georgia, and run thence north 78 degrees 34 minutes 16 seconds east across a Graded County Road a distance of 610.62 feet to an iron pin found on the north right of way line of said Graded County Road and POINT OF BEGINNING of the tract herein described; run thence north 00 degrees 25 minutes 21 seconds west a distance of 461.47 feet to an iron pin set; run thence north 89 degrees 34 minutes 39 seconds east a distance of 274.06 feet to an ir on pin set; run thence south 00 degrees 40 minutes 18 seconds west beyond an iron pin found a distance of 508.67 feet to an iron pin found on the north right of way line of said Graded County Road; run thence north 80 degrees19 minutes 07 seconds west along the north right of way line of said Graded County Road distance of 268.51 feet to POINT OF BEGINNING, the tract herein described containing 3.00acres and is bounded north and west by other property of R.G. Hawkins and Masie Lee Hawkins; east by property of Harold L. Green; and south by the north right of way line of said Graded County Road, all as shown by plat of survey made by Larry W. Grogan, Georgia Registered Land Surveyor No 1549, dated February 5, 1990, a copy of which said plat is recorded in Plat Book 4, page 136, records of Baker County, Georgia. LESS AND EXCEPT: From Sta. 38+29.66 to Sta. 40+90.49 a strip 30 feet wide left of the centerline of survey. Said right of way is more particularly described according to a plat of the right of way through the property of Delta Partners, Inc., prepared by Gene W. Webb, R.L.S. NO. 2923 and dated March 9, 2004 and made a part of the description. Said plat is attached hereto or is on file in the Office of the Clerk of Superior Court of Baker County, Georgia. Said right of way begins at Station 38+29.66 which is the boundary line between lands of Joseph E. Francis and the lands of the undersigned and continues to Station 40+90.49 which is the boundary line between lands of the undersigned and lands of Howard L. Green and Hazel L. Green and totals 0.171 acres.
