NOTICE OF SALE UNDER POWER, GLYNN COUNTY Pursuant to the Power of Sale contained in a Security Deed given by Robert Smith to Mortgage Electronic Registration Systems, Inc. as nominee for AHM Mortgage dated 5/12/2006 and recorded in Deed Book 1946 Page 153, GLYNN County, Georgia records; as last transferred to Deutsche Bank National Trust Company, as Trustee for HarborView Mortgage Loan Trust, Mortgage Loan Pass-Through Certificates, Series 2006-7, conveying the after-described property to secure a Note in the original principal amount of $ 528,750.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of GLYNN County, Georgia, within the legal hours of sale on the first Tuesday in December, 2012 (December 4, 2012), the following described property: All that certain lot, tract or parcel of land situate, lying and being in the 25th GM District of Glynn County, Georgia, on St. Simons Island, being ALL OF LOT NUMBERED FIVE (5), BLOCK 'B', THE MARSHES SUBDIVISION, according to the official plat of said Subdivision by John H. Ringeling, Registered Land Surveyor Number 751, dated January 3, 1974, of record in the Office of the Clerk of the Superior Court of Glynn County, Georgia in Plat Drawer 11, as Map Number 437. Also conveyed hereby is that certain real property lying adjacent to and in the west of Lot 5 of the aforesaid Block 'B', the Marshes Subdivision, and said additional parcel as well as Lot 5 being more particularly described and identified according to a plat made by Robert N. Shupe, Georgia Registered Land Surveyor Number 2224, dated April 25, 1992, and attached to that deed recorded in said records at Deed Book 1002, page 730 for all purposes, as follows, to-wit: Beginning at a point of the westerly right of way line of Marsh Circle located 1104.00 feet from the intersection of Marsh Circle with Rivera Drive and from said point running thence southerly on a curve along the westerly right-of-way line of Marsh Circle for a distance of 25 feet to a point marked by an iron pin; thence continuing along the westerly right-of-way line of Marsh Circle south 04 degrees 13 minutes 00 seconds west for a distance of 75 feet to a point; thence running north 85 degrees 47 minutes 00 seconds west for a distance of 214.87 feet to a point; thence running North 40 degrees 21 minutes 14 seconds West for a distance of 26.67 feet to a point; thence running north 15 degrees 35 minutes 00 seconds east for a distance of 51.99 feet to a point; thence running north 11 degrees 15 minutes 35 seconds west for a distance of 96.76 feet to a point; thence running south 71 degrees 39 minutes 33 seconds east for a distance of 260.13 feet to the point or place of beginning. The aforesaid property is subject to a 30 foot drainage easement as shown on said plat. PARCEL# 04-01617 The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed.
